Mr. L.Q. T has 1,000 m2 of land in Phu Quy island, 1/3 of the area of this land plot is in the commercial service land plan but has not been allowed to transfer because functional agencies replied that there is no detailed plan.
Mr. T asked, is the remaining area outside the commercial service land plan and not entangled in any other planning that he is allowed to convert to multi-purpose land for use?
The Ministry of Agriculture and Environment answers this question as follows:
Article 121 of the 2024 Land Law stipulates cases of changing land use purposes.
Clause 1, Article 218 of the 2024 Land Law, Article 9 of Decree No. 49/2026/ND-CP dated January 31, 2026 of the Government detailing and guiding a number of articles of Resolution No. 254/2025/QH15 of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in the organization of the implementation of the Land Law have stipulated types of land that can be used for multi-purpose land use, in which Clause 2, Article 218 of the 2024 Land Law stipulates the requirements to be met when using land for multi-purpose land use and Clause 2, Article 99 of Decree No. 102/2024/ND-CP stipulates the scope and conditions for using land for multi-purpose land use.
At the same time, on January 31, 2026, the Government issued Decree No. 49/2026/ND-CP detailing and guiding a number of articles of Resolution No. 254/2025/QH15 of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, which has stipulated the decentralization of authority to provincial-level People's Committees to decide on land allocation, land lease, permission to change land use purposes, approval and approval of land use plans; regulations on administrative procedures on land (in Articles 14 and 15 of Decree No. 49/2026/ND-CP).
Based on the above regulations, the change of land use purpose and the use of land combined with multiple purposes are two different cases.
