The Ministry of Construction has just issued Official Dispatch No. 11067/BXD-QLN to the Committee for Petitions and Supervision of the National Assembly; the delegation of National Assembly deputies of Hanoi City responded to voters' petitions sent after the first session, 16th National Assembly.
Accordingly, the Ministry of Construction received a petition from Hanoi City voters transferred by the National Assembly's Committee for Petitions and Supervision in Document No. 498/UBDNGS16 dated June 12, 2026 regarding the transfer of voters' petitions sent after the First Session, 16th National Assembly.
According to the content of the petition, voters proposed that the Ministry of Construction, when reviewing and amending the Housing Law, should study, amend, and improve regulations on management and operation of apartment buildings in the direction of: assigning the responsibility for management, operation, and maintenance of the project to the investor (or hired professional unit) to be responsible throughout until the project expires.
This must be considered a criterion for evaluating prestige to approve subsequent investment projects of enterprises; the role of the Apartment Building Management Board from the position of "implementing unit" to an independent "supervisory agency", helping to eliminate conflicts of interest, ensuring professionalism and transparency.
After studying, the Ministry of Construction responded as follows:
The 2023 Housing Law and guiding documents have regulations on the responsibilities of investors in the period before the establishment of the Apartment Building Management Board; responsibilities of the Apartment Building Management Board, apartment building management and operation units, owners and users of apartment buildings in the management and use of apartment buildings.
Currently, implementing the tasks assigned by the Government, the Ministry of Construction is studying and amending the 2023 Housing Law. The Ministry of Construction would like to acknowledge the voters' recommendations, in the process of drafting the Housing Law (amended) and guiding documents for implementation, the Ministry of Construction will continue to study and report to competent authorities for consideration of amendments and supplements to clearly stipulate the responsibilities of investors, operating management units, and Management Boards in managing and maintaining apartment buildings to suit reality, ensuring professionalism, transparency, management efficiency and protecting the legitimate rights and interests of residents.
The Ministry of Construction respectfully sends the Delegation of National Assembly Deputies of Hanoi City to inform voters; sends to the Committee for Petitions and Supervision of the National Assembly to summarize, monitor, and supervise according to regulations.
