The Ministry of Construction has just issued Document No. 11689/BXD-KTQLXD to the Committee for Petitions and Supervision of the National Assembly, the Delegation of National Assembly Deputies of Ho Chi Minh City to respond to the recommendations of voters in Ho Chi Minh City sent after the First Session, 16th National Assembly.
According to the content of the petition, voters believe that some regulations related to construction permit issuance still have overlaps between the Construction Law, 2024 Land Law, Planning Law and other specialized regulations, leading to complicated administrative procedures, prolonged dossier processing time, causing difficulties for people and businesses. Many cases have to go through many agencies, supplement dossiers many times or wait for inter-sectoral opinions, thus increasing costs and affecting investment and construction progress.
Therefore, voters proposed that the Ministry of Construction preside over and coordinate with relevant ministries and sectors to review, amend and unify relevant legal regulations in a synchronous and clear direction, reduce intermediary procedures, and promote the application of digital technology in resolving dossiers to create favorable conditions for people, improve the efficiency of state management and improve the investment and business environment.
After researching, the Ministry of Construction answers this question as follows:
Construction Law No. 135/2025/QH15 was passed by the National Assembly on December 10, 2025. To guide the implementation of Construction Law No. 135/2025/QH15, the Government issued Decree No. 217/2026/ND-CP dated June 19, 2026 detailing a number of articles of the Construction Law on construction activity management, Decree No. 212/2026/ND-CP dated June 17, 2026 Regulating conditions for construction activity capacity, Information System, National database on construction activities.
Based on the Decrees guiding the implementation of the Construction Law No. 135/2025/QH15, the Ministry of Construction issued Circular No. 39/2026/TT-BXD dated June 26, 2026 Guiding some detailed information in the information system, National Database on construction activities, Decision No. 1077/QD-BXD dated June 29, 2026 on announcing administrative procedures to replace and abolish construction activities under the management functions of the Ministry of Construction.
The content on issuing construction permits is regulated in Decree No. 217/2026/ND-CP. This content is researched to ensure synchronization with the provisions of law on planning and construction, meeting the requirement to reduce administrative procedures for projects that have been appraised by specialized construction agencies for the Construction Feasibility Study Report, construction permits are exempted, and at the same time, the time for carrying out administrative procedures is reduced.
The implementation of administrative procedures for Construction Permits is specifically regulated in Decision No. 1077/QD-BXD. The contents on the order of implementation, methods of implementation, composition, number of dossiers, time of implementation of administrative procedures, subjects of administrative procedures, agencies resolving administrative procedures, results of administrative procedure implementation, and types of application forms are specifically regulated in the above Decision.
Regarding the implementation of construction permit procedures on the centralized administrative procedure system of the Ministry of Construction, the receipt and return of results are carried out online on the Information System, the National Database on Construction Activities and towards implementing full-stage administrative procedures.
The Ministry of Construction is deploying the Information System and National Database on construction activities of the next version according to the contents of Decree No. 212/2026/ND-CP, Circular No. 39/2026/TT-BXD. The deployment of the Information System and National Database on construction activities of this version is to meet the requirements of linking national databases, using data in administrative procedures, and issuing construction permits in the form of online full process.
Regarding this matter, the Ministry of Construction will continue to implement and inform the implementation results to the Delegation of National Assembly Deputies of Ho Chi Minh City, the Committee for Petitions and Supervision of the National Assembly when there are implementation results. The Ministry of Construction respectfully sends the Delegation of National Assembly Deputies of Ho Chi Minh City to inform voters; sends to the Committee for Petitions and Supervision of the National Assembly for synthesis, monitoring, and supervision according to regulations.
