This decision takes effect from June 22, 2026 and is implemented until the end of February 28, 2027.
According to new regulations, the Chairman of the Commune-level People's Committee is assigned to perform many important tasks that previously belonged to the authority of the City People's Committee. The decentralization aims to increase the proactiveness of grassroots authorities, shorten the time to resolve administrative procedures and improve the efficiency of state management of land.
In the field of land recovery, the Chairman of the Commune-level People's Committee is issued a notice of land recovery; decisions to establish the Compensation, Support, and Resettlement Council; approval of compensation, support, and resettlement plans; decisions to compulsory inventory and organize forced inventory when necessary.
The commune level is also granted the authority to approve the land recovery coercion plan, decide on coercion to implement the land recovery decision and establish committees to serve coercion work in accordance with the law.
Notably, the Chairman of the Commune-level People's Committee is allowed to decide on land recovery in many cases according to the Land Law; approve the agricultural land use plan of economic organizations and approve the rice land use plan of individuals.
In addition, communes are allowed to decide on land allocation, land lease, permit land use purpose conversion, extension of land use, and change of form of land use for many cases under their authority according to regulations. The decentralization mainly applies to cases of land allocation without land use fees, annual land lease payments or full exemption from financial obligations related to land.
The Chairman of the commune-level People's Committee is also assigned the authority to recognize land use rights, allocate agricultural land to individuals, and decide on a number of cases of land allocation and land lease related to airports, civil airports and land of agricultural and forestry companies according to regulations.
In addition, communes are approved for plans to contribute land use rights, adjust land; consider approving or not approving the receipt of land use rights to implement projects; decide on multi-purpose land use plans within the scope of decentralization.
The granting of more authority to commune-level authorities is expected to create conditions to resolve land procedures at the grassroots level faster, while enhancing the responsibility of localities in managing, using and effectively exploiting land resources.
