Regarding the above content, the Ministry of Agriculture and Environment said that according to the provisions of the 2024 Land Law, the conversion of land use purposes from agricultural land to non-agricultural land, including residential land, is subject to permission from competent state agencies.
According to current regulations, land users are not allowed to arbitrarily convert crop land to residential land just because they have a need to build houses. The consideration of changing land use purposes must be based on the land use plan approved by competent authorities.
For households and individuals, in case agricultural land is located in residential areas or in the same land plot with residential land, the conversion to residential land will be considered based on district-level land use planning, general planning or zoning planning.

Regarding the implementation procedure, people need to submit a dossier requesting land use purpose conversion to a competent authority. After receiving the dossier, the land management agency will check the conversion conditions, appraise the dossier and submit it to the competent authority for decision issuance if it meets the conditions.
After being approved, land users must fully fulfill financial obligations according to regulations before functional agencies update and revise the Certificate of Land Use Rights.
In addition to land use fees, people may have to pay some additional fees and charges such as certificate fee, registration fee or dossier appraisal fee depending on the regulations of each locality.
Legal experts also noted that before buying land for planting trees for the purpose of building houses, people need to carefully research planning information. If the land area is not in the planning that allows conversion to residential land, it will not be possible to carry out conversion procedures, even if the land user has a need.
