Pursuant to Clause 8, Article 76 of the Housing Law 2023, cadres, civil servants and public employees are one of the beneficiaries of social housing support policies and are eligible to buy social housing according to Clause 1, Article 77 of the Housing Law 2023.
In which, compared with Clause 1, Article 78 of the 2023 Housing Law, this subject must ensure:
- Housing conditions.
- Income conditions.
(1) Housing conditions
Currently, there are no new amendments applying the provisions at Point a, Clause 1, Article 78 of the 2023 Housing Law, Article 29 of Decree 100/2024/ND-CP and Article 9 of Resolution 201/2025/QH15.
Accordingly, cadres, civil servants and public employees must meet the following conditions to buy social housing:
- Not having a house of one's own in the province or centrally run city where there is a social housing construction investment project, not having bought or rented social housing, not having enjoyed housing support policies in any form in the province or centrally run city where there is a social housing construction investment project.
Not having a house under their ownership is determined when the petitioner and the husband or wife of that subject (if any) are not listed in the Certificate of land use rights and ownership of assets attached to land in the province or centrally-run city where the social housing project is located at the time of submitting the application for registration to buy or rent social housing.
- Or have a house of one's own in a province or centrally run city where there is a social housing project but the average housing area per capita is lower than the minimum housing area.
Having a house of one's own but the average housing area per capita is less than 15m2 of floor space/person. The average housing area per capita prescribed in this clause is determined on the basis of: the single person, the person's wife (husband), father, mother (if any) and children of that person (if any) registering to reside permanently in that house.
Note: If you are a cadre, civil servant, or public employee who is eligible for public housing rentals, you must not be living in a public housing facility.
(2) Income conditions
Conditions on income for cadres, civil servants and public employees to buy social housing apply under Point b, Clause 1, Article 78 of the 2023 Housing Law, Article 30 of Decree 100/2024/ND-CP amended and supplemented by Clause 2, Article 1 of Decree 261/2025/ND-CP.
Accordingly, cadres, civil servants and public employees must meet the income requirements according to Government regulations to buy social housing. Ensure income conditions as follows:
- In case the plaintiff is unmarried or confirmed to be single, having an actual average monthly income of not more than 20 million VND shall be received according to the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works.
In case the petitioner is an unmarried person or is confirmed to be single and raising a child under the age of majority, the actual average monthly income received shall not exceed 30 million VND as calculated in the Salary Table, confirmed by the agency, unit or enterprise where the subject works.
- In case the plaintiff is married according to the provisions of law, the plaintiff and his/her husband (husband) with a total average monthly income shall receive no more than 40 million VND in equity according to the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works.
- The time to determine income conditions as prescribed in Point a, Point b of this Clause is within 12 consecutive months, calculated from the time the competent authority implements the confirmation.
- Based on the conditions and income levels of each area in the area, preferential housing policies for cadres, civil servants, and public employees, and the number of dependents according to the provisions of law, the Provincial People's Committee may decide on the coefficient for adjusting the income level prescribed in Point a and Point b of this Clause but not exceeding the ratio of local per capita income to the national per capita income; decide on policies to encourage access to social housing for beneficiaries of social housing support policies with three (03) dependents or more in the same household.
Note: Decree 261/2025/ND-CP takes effect from October 10, 2025.
Thus, cadres, civil servants and public employees when buying social housing from October 10, 2025 must ensure the above conditions.
