The Government issued Decree 49/2026/ND-CP (effective from January 31, 2026) guiding Resolution 254/2025/QH15 stipulating mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.
Accordingly, based on Clause 2, Article 12 of Decree 49 amending Article 5 of Decree 101/2024/ND-CP stipulating the implementation of cadastral surveying and mapping as follows:
1. Review and determine the area to be mapped: The provincial-level land management agency organizes the review, identification, and synthesis of the needs for surveying and mapping to report to the provincial-level People's Committee to decide on the area and scope to be mapped.
For the area where the cadastral map measurement is carried out, the provincial-level land management agency shall approve and allow it to be carried out simultaneously with the process of appraising the task plan proposed by the investor specified in Clause 3 of this Article, except for cases where the cadastral map measurement is carried out to serve state management of land under the authority of the commune level.
2. Surveying, preparing technical design - cost estimate, task plan: Agencies and units assigned tasks or agencies and units assigned to be investors (hereinafter referred to as project and task investors) are responsible for organizing surveys of surveyed areas to make cadastral maps, preparing and submitting for approval technical design - cost estimate, task plan; project and task investors are selected as consulting units to prepare technical design - cost estimate, task plan for implementation in accordance with the law.
3. Appraisal of technical design - estimate, task plan: A provincial-level land management agency is responsible for appraising technical design in technical design - estimate, task plan. A commune-level land management agency is responsible for organizing the implementation of technical appraisal in the task plan, technical design - estimate for cases of extracting and measuring cadastral maps or measuring and adjusting cadastral maps to serve state management of land under the authority of the commune level. The appraisal agency for cost estimates in technical design - estimate, task plan shall be carried out in accordance with the law on state budget management.
4. Approving technical design - estimate, task plan and allocation of implementation funds: The competent authority is responsible for approving technical design - estimate, task plan and allocation of implementation funds in accordance with the law on budget management.
5. Deploy technical design - estimate, task plan after being approved, including:
- Selection of implementing units: To implement technical design - estimate, task plan, project and task investors are allowed to choose construction consulting units; it is allowed to choose supervision and inspection consulting units or project and task investors are allowed to self-implement supervision and inspection;
- Develop implementation plans;
- Disseminate and propagate the implementation plan;
- Establish cadastral networks, measuring and drawing control networks (if any);
- Collect information and data about land plots, land users, and land recipients for management;
- Determine the boundary of the land plot; prepare a description of the boundary and landmark of the land plot;
- Measure and draw the boundary of the land plot and related geographical objects;
- Compiling cadastral maps; preparing certificates of measurement results of land plot status; publicizing cadastral maps;
- Establish land registers;
- Sign confirmation, product approval;
- Hand over the product.
