Mr. P.V.L in Dong Nai asked, his company was granted a map measurement license with the content "measuring and establishing terrain maps at scales of 1:500, 1:1.000, 1:2.000, 1:5,000".
Mr. L asked, is the company allowed to measure and create a riverbed topographic map?
While this content is not in the list of measurement and map activities that must have a license specified in Article 29 of Decree No. 27/2019/ND-CP dated March 13, 2019 of the Government detailing a number of articles of the Law on Measurement and Map, amended and supplemented in Clause 5, Article 1 of Decree No. 136/2021/ND-CP.
The Ministry of Agriculture and Environment answers this question as follows:
Clause 4, Article 3 of the Law on Measurement and Mapping stipulates: "Measurement and mapping activities are the measurement of geographical objects; construction and operation of measurement infrastructure works, geographical databases; establishment of maps, production of measurement products and other maps. Measurement and mapping activities include basic measurement and mapping activities and specialized measurement and mapping activities".
Clause 12, Article 3 of the Law on Surveying and Mapping stipulates: "Geographical maps are maps showing geographical characteristics, geological features and geographical names according to coordinate systems, altitude systems, at a determined ratio".
Article 29 of Decree No. 27/2019/ND-CP dated March 13, 2019 (amended and supplemented in Clause 5, Article 1 of Decree No. 136/2021/ND-CP dated December 31, 2021) of the Government detailing a number of articles of the Law on Surveying and Mapping stipulates the List of surveying activities and maps that must be licensed.
The content "Measuring and establishing topographic maps at scales of 1:500, 1:1.000, 1:2.000, 1:5,000" is a measurement activity and maps must have a license specified in Clause 7, Article 29 of Decree No. 27/2019/ND-CP (amended and supplemented in Clause 5, Article 1 of Decree No. 136/2021/ND-CP) of the Government detailing a number of articles of the Law on Measurement and Cartography.
Therefore, in cases where organizations are licensed to carry out surveying and mapping activities with the content "Measuring and establishing topographic maps at scales of 1:500, 1:1.000, 1:2.000, 1:5,000", they are only allowed to carry out surveying and mapping activities according to the content of the license issued; they are not allowed to carry out riverbed topographic surveying activities.
The Vietnam Department of Surveying, Mapping and Geographic Information does not have documents or records related to the task of measuring riverbed terrain that he mentioned.
Therefore, the Department does not have a basis to consider and answer about the content of riverbed topographic measurement mentioned above belonging to the List of measurement activities and maps that must have any permits according to regulations.
