When the payment for purchasing individual social housing is completed, the competent authority issues a Certificate of land use rights, ownership of assets attached to land with a land use term of 50 years or long-term stability? Meanwhile, the Certificate of land use rights issued to project investors has a land use term of 50 years.
The Ministry of Agriculture and Environment has the following opinions:
According to the provisions of Article 171 of the 2024 Land Law, residential land is a type of land used stably and long-term. For social housing projects, investors are allocated land or leased land by the State to implement projects with a term according to Article 172 of the 2024 Land Law, usually not exceeding 50 years. This is the operating term of the project, not the land use term of homebuyers.
Clause 3, Article 92 of Decree No. 102/2024/ND-CP stipulates that buyers of apartments or houses in social housing projects are granted Certificates for housing area and common land area with a long-term stable use term.
Therefore, when citizens complete the purchase of social housing, the Certificate of land use rights and house ownership issued to citizens will record the long-term stable land use term.
