Hanoi is seeking opinions on a draft regulation on the management and use of old houses belonging to public assets. Notably, the draft proposes to decentralize many powers to the Department of Construction in managing, leasing and selling this type of housing.
According to the draft regulations on some contents on management and use of old houses belonging to public assets in the city, the Department of Construction is assigned to approve the subjects renting old houses belonging to public assets.
The Department of Construction is also proposed to decide on the sale of old houses belonging to public assets, including determining the buyer, house address for sale, house selling price, land use right transfer price, housing area and common land area related to the house being sold.
In the financial field, the Department of Finance is assigned to approve the rental price of old houses belonging to public assets in the city, and at the same time approve the revenue and expenditure estimates for the management and operation of this housing fund.
The draft stipulates the scope of regulation including the receipt, management, use, maintenance, lease, sale of old houses belonging to public property; issuance of Certificates of land use rights, house ownership and other assets attached to land; handling violations, recovery, coercive handover of houses; and clearly stipulates the responsibilities of relevant agencies, units and individuals.
According to the draft, agencies and units that are self-managing old public housing must hand over the housing fund to the city for receipt, management, lease and sale according to regulations. The Department of Construction is assigned a decision to receive the old housing fund under the self-management agency status after completing dossiers and procedures according to legal regulations.
Regarding the lease of old houses belonging to public property, lease contracts are only signed for areas without disputes or lawsuits. Cases of changing members in the lease contract, transferring lease rights or leaseholders passing away are also specifically guided to ensure the rights of legal home users.
Regarding the sale of old houses belonging to public assets, the draft continues to implement according to current regulations and assigns the Department of Construction to sign purchase and sale contracts in the city. Some special cases will be carried out by the commune-level People's Committee for selling houses and issuing Certificates according to regulations.
The city expects that promoting decentralization will shorten the time to resolve dossiers for renting and buying old public housing. Instead of having to go through many steps of appraisal and submitting to the City People's Committee for decision as before, specialized agencies will directly handle contents within their management scope.
The draft also clearly stipulates the principles of management and use of shared areas such as terraces, corridors, common walkways, stairs and auxiliary works. Households must maintain the current status of legal use, not encroach or use it to affect the interests of other households.
