Many land violations in Soc Son district in the past
Hanoi City People's Committee has just issued Conclusion No. 146/KL-UBND dated August 3, 2026 concluding the content of the denunciation against Mr. Pham Quang Ngoc - Vice Chairman of Soc Son District People's Committee (formerly), now Chairman of Soc Son Commune People's Committee.
According to the document, citizens accuse Mr. Pham Quang Ngoc of signing and issuing Document No. 1060/UBND TNMT dated May 8, 2025 of Soc Son District People's Committee responding to Ms. Nguyen Thi Tuyen's petition not in accordance with the provisions of law, covering up violations in Xuan Giang commune, Soc Son district (now Da Phuc commune) on 3 contents:
Document No. 1060/UBND-TNMT dated May 8, 2025 responding to citizens about the absence of sand and gravel exploitation in Trai Phung area (as of June 2025) is incorrect; citizens believe that there is sand and gravel exploitation, turning the area of agricultural land in this area into swamps and lakes.
Document No. 1060/UBND-TNMT dated May 8, 2025 responding to the content reflecting that Mr. Nguyen Van Hoa - former Chairman of Xuan Giang Commune People's Committee dug agricultural land in Bai Gieng field, Yen Sao village (rice-growing land area) for sale is incorrect.
Citizens believe that in fact, this area has excavation, digging of soil at night and taking it to sell, an area of about 3,600 m2 and in which there is a 70m2 area of Ms. Nguyen Thi Tuyen's family (this area has been certified).
Document No. 1060/UBND-TNMT dated May 8, 2025 responding to the content reflecting that Mr. Nguyen Van Hoa - former Chairman of Xuan Giang Commune People's Committee surrounded with corrugated iron on agricultural land in Yen Sao village, field 2 Bai Gieng is incorrect.
Citizens believe that in reality, there are still corrugated iron fences and barbed wire fences on agricultural land.
According to the Hanoi People's Committee, the results of verifying the first content, at Trai Phung area, there was excavation and digging of soil that changed the current status of agricultural land use.
The content of Document No. 1060/UBND-TNMT responding to citizens, showing that there is no exploitation of sand and gravel, no phenomenon of subsidence and cracking of cultivated land and fields of people in this area is incorrect.
The actual inspection results (March 6, 2026) chaired by the Hanoi City Inspectorate showed that excavation and digging of soil (size about 5m long, about 3m wide, about 3m deep) changed the current land use status, different from the inspection time on November 4, 2025. The current status is no longer land used for agricultural production purposes.
The responsibility for the above-mentioned acts of land destruction lies with the Chairman of Da Phuc Commune People's Committee at the time of implementing the 2-level government to date.
The second content verification result: Document No. 1060/UBND-TNMT responding to citizens regarding the content reflecting that Mr. Nguyen Van Hoa - Chairman of Xuan Giang Commune People's Committee digging agricultural land in Bai Gieng field, Yen Sao village is incorrect.
According to the Da Phuc Commune People's Committee's report and the results of working with households with land: During the land use process, households lent land to Mr. Nguyen Van Bac to grow lotus and release snails (at the time of 2024).
Mr. Bac dug soil and scooped soil to fill in ditches and roads along the field, changing the current status from rice land to pond land, but the Commune People's Committee did not inspect; there is no basis to determine that there is an act of scooping soil for sale.
In 2024, Xuan Giang Commune People's Committee did not sanction, did not make records of handling, and prevented the acts of digging land, changing the current status of land use of Mr. Nguyen Van Bac, allowing the violations to persist to this day, which is a violation of the provisions of Clause 2, Article 208 of the 2013 Land Law; Point b, Clause 1, Article 241 of the 2024 Land Law stipulates the responsibility of the Chairman of the Commune-level People's Committee in detecting, preventing and handling violations of the law on land management and use.
The responsibility belongs to the Chairman of Xuan Giang Commune People's Committee from the period from 2024 to June 30, 2025, and the Chairman of Da Phuc Commune People's Committee from July 1, 2025 to now in detecting, preventing, and handling violations according to regulations, forcing violators to restore the original state of the land.
In Bai Gieng area, there is excavation and digging of soil, changing the current status of agricultural land.
Therefore, Document No. 1060/UBND-TNMT of Soc Son District People's Committee previously responding to citizens with the content that the current situation shows no signs of soil exploitation or excavation does not fully and objectively reflect the nature of the case.
The result of verifying the third content: Document No. 1060/UBND-TNMT responding to the content of citizens reflecting that Mr. Nguyen Van Hoa - Chairman of Xuan Giang Commune People's Committee surrounded with corrugated iron on agricultural land in Yen Sao village, Bai Gieng field is incorrect.
According to the report of Da Phuc Commune People's Committee, during the land use process, around 2024, households Nguyen Van Nguyen, Nguyen Van Cu and Nguyen Van Kiem, Vu Van Thanh, Nguyen Thi Mui and Nguyen Van Lap lent Mr. Nguyen Van Bac land to plant bananas, Mr. Bac erected corrugated iron walls on the road surface about 100m long to make fences to prevent land.
In 2024, Xuan Giang Commune People's Committee (formerly) based on the direction of Soc Son District People's Committee requested the dismantling of the corrugated iron fence of Mr. Nguyen Van Bac.
Mr. Nguyen Van Bac has dismantled and collected corrugated iron fences to make the boundary of the land plot out of the land plot, while the gate section about 3m long and barbed wire fence, Mr. Bac kept to make the gate and fence, not yet dismantled.
The conclusion of the Hanoi City People's Committee clearly stated: Xuan Giang Commune People's Committee (formerly) and Da Phuc Commune People's Committee lacked inspection and supervision, leading to violations that have not been thoroughly handled according to the direction of Soc Son District People's Committee (formerly).
The responsibility belongs to the Chairman of Xuan Giang Commune People's Committee (formerly) from 2024 to June 30, 2025, and Da Phuc Commune People's Committee from July 2025 to before June 25, 2026.
On June 26, 2026, Da Phuc Commune People's Committee overcame violations, dismantled all corrugated iron fences and barbed wire surrounding the land plot.
Reviewing the responsibility of many former officials of Soc Son District People's Committee
From the above contents, Hanoi City People's Committee requests Mr. Pham Quang Ngoc - Chairman of Soc Son Commune People's Committee to seriously review and draw experience for violations and shortcomings during his time as Vice Chairman of Soc Son District People's Committee (from 2024 to June 30, 2025) who was irresponsible in approving and signing document No. 1060/UBND-TNMT dated May 8, 2025, answering citizens with inaccurate content, leading to the situation of citizens having complaints; to date, violations in the field of land have not been resolved definitively.
Assign the Chairman of Da Phuc Commune People's Committee: Organize self-criticism and take disciplinary action against the Chairman of Xuan Giang Commune People's Committee (period from 2013 to June 30, 2025) and related officials for the shortcomings mentioned in this conclusion (lax management, failure to detect, prevent and handle promptly according to authority for acts of digging land and destroying agricultural land in Trai Phung area;
Not fully and thoroughly implementing the previous document of Soc Son District People's Committee on urging the clearance of cases of corrugated iron fences on agricultural land in Bai Gieng area, not urging and supervising the implementation of the administrative penalty decision issued against Mr. Nguyen Van Loi.
Organize a review of responsibility for Ms. Hoang Thi Ha - Vice Chairwoman of Da Phuc Commune People's Committee in charge of land; review responsibility and take disciplinary action against the Head of the Economic Department of Da Phuc Commune in the period from July 1, 2025 to date for the shortcomings mentioned in this conclusion (not promptly detecting, preventing and handling violations of the law on land management and use in Trai Phung and Bai Gieng areas).
Prepare dossiers for handling administrative violations for violations in Trai Phung area and Bai Gieng area according to the authority and regulations in Decree 123/2024/ND-CP of the Government on sanctioning administrative violations in the field of land.
In case the violator does not comply with the decision to sanction administrative violations, the file will be transferred to the police agency for investigation and handling according to regulations.
At the same time, seriously perform the functions and tasks in detecting, preventing and handling violations of the law on land management and use in the entire Da Phuc commune according to the provisions of law and point b, clause 1, Article 241 of the 2024 Land Law and legal regulations.
Assigning the Chairman of Kim Anh Commune People's Committee: Organize self-criticism and draw experience for Mr. Nguyen Van Toan - Vice Chairman of Kim Anh Commune People's Committee during his time as Head of the Department of Natural Resources and Environment (then Head of the Department of Agriculture and Environment of Soc Son district) who made mistakes and was irresponsible in his role as head in advising on documents of Soc Son district (old) People's Committee that were not accurate according to the verification results stated in this conclusion.
