The People's Committee of Hai Duong province issued Decision No. 37/2024/QD-UBND stipulating land allocation limits, residential land recognition limits, agricultural land use right transfer limits; conditions for land division and land consolidation; minimum area allowed for land division and land consolidation in Hai Duong province. The new decision takes effect from September 12.
Accordingly, the minimum area allowed to separate land plots is as follows:
For residential land
Residential land in urban areas: 30m2 and the side adjacent to the road or common path is at least 3m; the depth into the land perpendicular to the road or common path is at least 5m.
Residential land in rural areas: 60m2 and the minimum side adjacent to the main road is 4m, the minimum depth into the plot perpendicular to the main road is 5m.
For land plots for growing annual crops, perennial crops, and aquaculture:
Land for growing rice and annual crops outside residential areas: 500m2.
Land for growing annual crops, perennial crops, and aquaculture not located on the same plot of land with a house in a residential area or in a residential area planning approved by a competent authority, in accordance with residential land planning: 80m2 for urban areas and has a minimum road-facing side size of 3m, 120m2 for rural areas and 180m2 for mountainous rural areas and has a minimum road-facing side size of 4m.
Land for growing annual crops, perennial crops, and aquaculture not located on the same plot of land with a house in a residential area or in a residential area planning approved by a competent authority, but not in accordance with residential land planning: 300m2.
Land for growing perennial crops, aquaculture or land for aquaculture combined with growing perennial crops outside residential areas or areas with crop structure conversion: 1,000m2 (one thousand square meters).
For forestry land (forest land): 5,000m2 (five thousand square meters).
For commercial and service land plots:
Land of individuals whose land use rights are recognized by the State and located in urban residential areas or within urban residential planning approved by competent authorities: 100 m2 (one hundred square meters) and with a minimum side adjacent to the main road of 3m (three meters).
Land of individuals whose land use rights are recognized by the State and located in rural residential areas or within rural residential area planning approved by competent authorities: 200m2 (two hundred square meters) and with a minimum side adjacent to the main road of 4m (four meters).
Land allocated by the state, land leased for project implementation and located in urban areas or within urban planning approved by competent authorities: 1,000m2.
Land allocated or leased by the state for project implementation and located in rural areas or within the planning of rural residential areas or concentrated production and business planning areas approved by competent authorities: 2,000m2.
Land allocated or leased by the State for project implementation and located in industrial parks, industrial clusters, craft villages or in the planning of industrial parks, industrial clusters, craft villages approved by competent authorities: 3,000m2.
For non-agricultural production land plots allocated or leased by the State to implement projects:
Land in concentrated production and business planning area: 3,000m2 (three thousand square meters).
Land located in industrial parks, industrial clusters, craft villages or in the planning of industrial parks, industrial clusters, craft villages approved by competent authorities: 5,000 m2.
