Ms. T asked, now that she is applying for a red book for the first time, is the land recognition limit for residential land adjusted according to the limit of mountainous areas?
The Ministry of Agriculture and Environment answers this question as follows:
Point a, Clause 3, Article 9 of the 2024 Land Law stipulates residential land, including residential land in rural areas (ONT), residential land in urban areas (ODT).
In points a, b, clause 1, Article 5 of Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government, amended and supplemented in clause 1, Article 13 of Decree No. 49/2026/ND-CP, it is stipulated that residential land in rural areas is residential land within the boundaries of commune administrative units and special zones where local authorities in special zones perform the corresponding tasks and powers of local authorities in communes, except for residential land in areas implementing new urban construction projects according to urban planning approved by competent authorities but still within the boundaries of commune administrative units, corresponding special zones of local authorities in communes.
Thus, after arrangement, the administrative unit in the commune is identified as residential land in rural areas.
The residential land recognition limit is regulated by the Provincial People's Committee according to the provisions of Clause 5, Article 141 of the Land Law, therefore, the determination of the residential land recognition limit for her after merging administrative units is under the authority of the Hanoi City People's Committee.
