The Government has issued Decree 217/2026/ND-CP (effective July 1, 2026) detailing a number of articles of the 2025 Construction Law on construction activity management. In which, Article 58 of this Decree specifically stipulates the dossier for applying for a construction permit by stage. Specifically:
Article 58. Dossier for application for construction permit by stage
1. Application for a construction permit according to the provisions of Form No. 01 Appendix II issued together with this Decree.
2. One of the legal land documents for issuing a construction permit as prescribed in Article 55 of this Decree or a written approval from a competent authority on the location and route plan; a land recovery decision from a competent authority for the land area implemented in stages or the entire project according to the provisions of land law.
3. Documents as prescribed in point c, clause 1, Article 57 of this Decree. Including: Project approval decision; Report on the results of construction design appraisal as prescribed in this Decree (if any); results of administrative procedures according to the provisions of law on fire prevention and fighting and rescue for design dossiers requesting construction permits (if required); results of administrative procedures on environmental protection according to the provisions of law on environmental protection (if required); written opinions of specialized agencies on culture at the provincial level (if required).
4. The set of construction design drawings in the construction design dossier is implemented after the project is approved or the construction drawing design for the project only requires the preparation of an approved economic-technical report according to the provisions of the law on construction corresponding to the stage of applying for a construction permit as prescribed in point d, clause 1, Article 57 of this Decree.
Construction design drawings in construction design dossiers deployed after the project is approved or construction drawing designs for projects that only require the preparation of the approved economic-technical report or stamp confirmation according to the provisions of construction law, including: overall project ground plan drawings, project positioning ground plan drawings on land plots, architectural drawings of ground plans, main vertical and cross-sections of works (for works not following the route) or project route maps, overall ground plan drawings or project diagram drawings, drawings of the main vertical and horizontal cross-sections of the project route (for works following the route); ground plan drawings, foundation cross-sections; drawings showing the main structural solution of the project; ground plan drawings connected to the technical infrastructure system outside the project.
