Legal land documents for issuing construction permits from July 1, 2026

From July 1, 2026, Decree 217/2026/ND-CP specifically stipulates the types of legal land documents to be used when applying for a construction permit.

The Government has issued Decree 217/2026/ND-CP (effective July 1, 2026) detailing a number of articles of the 2025 Construction Law on construction activity management. In which, Article 55 of this Decree stipulates the types of legal land documents for issuing construction permits. Specifically:

Article 55. Legal documents on land for issuing construction permits

Legal land documents proving the suitability of land use purposes and ownership of works for issuing construction permits specified in this Decree are one of the following types:

1. Certificate of land use rights, ownership of houses and other assets attached to land.

2. Certificates of land use rights issued according to the provisions of land law through periods. Certificates of land use rights, ownership of assets attached to land issued according to the provisions of land law through periods.

3. Certificates of house ownership and residential land use rights issued in accordance with the provisions of land law and housing law through periods.

4. Certificates of house ownership; certificates of ownership of construction works that have been issued according to the provisions of land law, housing law, and construction law through periods.

5. Documents that meet the conditions for issuing certificates of land use rights and ownership of assets attached to land include: Documents specified in Article 137 of the 2024 Land Law; other types of documents that meet the conditions for issuing certificates of land use rights and ownership of assets attached to land according to the provisions of land law.

6. Land documents for cases where the State allocates land, leases land, changes land use purposes from after July 1, 2004 but does not have a certificate of land use rights, ownership of houses and other assets attached to land according to the provisions of land law, including one of the following types of documents: Decision to allocate land, lease land, permit to change land use purposes of a competent authority or land lease contract attached (if any) or documents on winning land use rights auctions, bidding for projects using land.

7. Report on the current status of land use for cases where religious organizations and affiliated religious organizations are using land but have not been granted certificates of land use rights, ownership of houses and other assets attached to land, which shall be inspected by the Provincial People's Committee where the land is located for actual use and handled according to the provisions of Article 142, Article 145 of the 2024 Land Law.

8. Documents on ranking historical - cultural relics, scenic spots or lists of relics according to the provisions of the law on cultural heritage for cases of issuing construction permits to carry out preservation, restoration, and recovery of historical - cultural relics and scenic spots but have not been granted certificates of land use rights, ownership of houses and other assets attached to land as prescribed.

9. Document approving the construction site of the District-level People's Committee (formerly) or the Commune-level People's Committee for the construction of advertising signs, telecommunications stations, antenna poles, power poles, power cables, distribution substations and other similar works in accordance with the law in the area not belonging to the land group for construction purposes for this type of project and not allowed to convert land use purposes.

10. Legal documents on land of forest owners and forest environmental lease contracts between forest owners and organizations and individuals implementing eco-tourism, resort, and entertainment projects in accordance with the law on forestry.

11. Certificate of land use rights or land allocation decision or land lease decision of a competent authority with the main land use purpose attached with a multi-purpose land use plan approved by the competent authority for cases of construction works on land used in combination with multi-purpose according to the provisions of Article 218 of the 2024 Land Law.

12. Land lease contract between the investor of the construction project and the manager and user of the traffic project or the approval document of the competent state management agency on traffic for the project allowed to be built within the land area reserved for traffic according to the provisions of law.

13. Documents of competent authorities that have issued land use right certificates determining the area of land types for cases where land users have one of the legal land documents as prescribed in Clauses 1, 2, 3, 4 and 5 of this Article, but on those documents, the area of land types is not clearly stated to serve as a basis for issuing construction permits.

14. In case the investor leases land or leases works, parts of works of the land user, owner of the work to invest in construction, in addition to one of the above documents, the person requesting a construction permit supplements the contract; legal agreement on land lease or lease of works, parts of works correspondingly.

15. Provincial People's Committees or decentralize and authorize commune-level People's Committees to regulate the area, location, purpose of use and approve the overall layout of construction works directly serving agricultural production on rice land.

16. Other legal documents according to land law regulations.
