Concept of current red book, pink book
Red book, pink book is the way people call it to refer to the Certificate of Land Use Rights, Home Ownership Rights and other assets attached to the land according to the color.
Clause 21, Article 3 of the 2024 Land Law stipulates: "A certificate of land use rights and ownership of assets attached to land is a legal document for the State to confirm the legal land use rights and ownership of assets attached to land of people with land use rights and ownership of assets attached to land.
Property attached to land that is granted a Certificate of land use rights and ownership of property attached to land is a house or construction works attached to land according to the provisions of law.
Certificates of land use rights, house ownership rights and other assets attached to land are issued in accordance with the provisions of relevant laws and implemented in accordance with the 2024 Land Law, with legal value equivalent to the Certificate of land use rights and ownership of assets attached to land prescribed in this Law".
Application for a red book according to the latest regulations
The current application for a red book includes the following documents: Application for land registration, assets attached to land. Documents for inheritance of land use rights under civil law in cases where a red book has not been granted.
Documents on inheritance or transfer of land use rights under civil law and under Clause 4, Article 45 of the 2024 Land Law.
Documents for land allocation without proper authority or purchase, liquidation, valuation, distribution of houses and works attached to land according to Article 140 of the Land Law (if any).
Documents for administrative sanctions in the field of land (if there are violations); contracts, agreements or decisions of the Court on the right to use adjacent land plots with a diagram of locations and areas with limited land use rights (if registered).
Documents determining members of the household's common land use rights (if any).
Land plot cadastral measure (if any).
The project design documents are appraised or the document approving the completion of acceptance.
According to Point a, Clause 6, Article 25 of Decree 101/2024/ND-CP: Decision on sanction and payment documents (if any).
Certificate of financial obligations or exemption or reduction documents (if any).
Documents on transfer of land use rights, ownership of houses and works signed by the parties but have not yet completed procedures according to regulations.
In case of granting a Certificate for a house or a construction work subject to a construction permit according to Clause 3, Article 148, Clause 3, Article 149 of the Land Law.
Current address for receiving red book applications
People prepare documents to apply for a red book and submit them to the One-stop Department according to the regulations of the Provincial People's Committee (PPC) on receiving documents and returning results of administrative procedures at the provincial and commune levels. Or people submit to the Land Registration Office; Branch of the Land Registration Office where the land is located.
According to Article 5 of Decree 151, the Chairman of the People's Committee at the commune level has the authority to issue red books to domestic individuals and overseas Vietnamese who are Vietnamese citizens and the community.
