Based on Section VIII. C Part V Appendix I issued together with Decree 151/2025/ND-CP corrected by Section 4 Appendix issued together with Clause 7 Article 1 of Decision 2418/QD-BNNMT in 2025 stipulating the dossiers and procedures for re-issuance of lost red books specifically as follows:
(1) Land users, owners of assets attached to land submit 1 set of dossiers to the One-Stop Shop Department or the Land Registration Office or the Branch of the Land Registration Office.
The dossier receiving agency performs:
- Check the completeness of the dossier components and issue a dossier receipt and result return appointment.
In case the dossier components are not complete, return the dossier with the Application Form for supplementation and completion of the dossier for the applicant to register for completion and supplementation according to regulations.
The dossier receipt and result return appointment and the Application Form for supplementation and completion of dossiers shall be implemented according to the forms specified in the Government's Decree on the implementation of the one-stop shop mechanism and inter-agency one-stop shop in resolving administrative procedures.
- In case the dossier receiving agency is the One-Stop Shop Department, transfer the dossier to the Land Registration Office.
Dossier includes:
- Application for registration of land and asset changes attached to land according to Form No. 18 issued together with Decree 151/2025/ND-CP;
- Excerpt from the cadastral map of the land plot for cases where land users need to measure to re-determine the dimensions of the edges and area of the land plot.
(2) The Land Registration Office performs the following tasks:
- Check information about the Certificate issued that the land user, owner of assets attached to the land declared lost in the cadastral records, land database;
- In case it is discovered that the land plot and assets attached to the land issued with a Certificate have been transferred land use rights, ownership of assets attached to the land or are being mortgaged at credit institutions, other economic organizations or individuals according to the provisions of law, notify and return the dossier to the land user and owner of assets attached to the land;
- In case it does not fall under the provisions of point b, Section 2, Part V, Appendix I issued together with Decree 151/2025/ND-CP, the Land Registration Office shall transfer information to the People's Committee of the commune where the land is located to implement the contents specified in Section 3, Part VIII, Appendix I issued together with Decree 151/2025/ND-CP for households and individuals; carry out 3 times on local mass media within 15 days about the loss of the Certificate issued for organizations, people of Vietnamese origin residing abroad, foreign organizations, foreign individuals, the cost of posting information is paid by land users and owners of assets attached to land;
- Implement the cancellation of the issued Certificate; update and revise cadastral records and land databases after implementing the contents specified in Section 3, Part VIII, Appendix I issued together with Decree 151/2025/ND-CP; reissue Certificates of land use rights and ownership of assets attached to land to the granted person.
In case the issued Certificate does not use the cadastral map or extract the cadastral map of the land plot, it shall be implemented according to the provisions at points b and c, Section 3, Part VI of "Part C. Order and procedures for registering land and assets attached to land" of Appendix I issued with Decree 151/2025/ND-CP.
(3) Commune-level People's Committees are responsible for performing the following tasks:
- Publicly list the loss of the issued Certificate at the headquarters of the People's Committee at the commune level and the residential area where the land is located within 15 days; and at the same time receive feedback during the public listing period about the loss of the issued Certificate;
- Within 5 days from the end of the listing period, the Commune-level People's Committee is responsible for making a record of the end of listing and sending it to the Land Registration Office.
(4) In case the supplementary page of the Certificate issued according to the provisions of land law before the effective date of Decree 151/2025/ND-CP is lost, the land user, owner of assets attached to land shall submit the Application for registration of land changes, assets attached to land according to Form No. 18 issued together with Decree 151/2025/ND-CP and the original Certificate issued.
The Land Registration Office checks the information of Trang supplemented in the cadastral records, land database; reissues Certificates of land use rights, ownership of assets attached to land with updated information of the Certificate issued and information on the Supplemented Page.
