Conditions for issuing a first red book
The 2024 Land Law stipulates that people are granted a first red book if they meet the following conditions:
Land in stable use and with documents in the groups specified in Articles 137, 148, 149 of the 2024 Land Law.
Land used stably but without documents, confirmed in accordance with planning, not violating land law or having fulfilled penalty obligations (if any).
Residential land or non-agricultural land used before July 1, 2014, without documents but confirmed by the People's Committee of the commune where the land is located that there is no dispute.
Agricultural land of households and individuals is being used stably and has been confirmed by the Commune People's Committee to be not in dispute.
In case of registration and meeting the conditions under Article 138 of the 2024 Land Law, the State is responsible for granting the certificate.
Application for first-time red book issuance
The dossier for initial issuance of red books is specifically regulated in Appendix V of Decree 151/2025/ND-CP. People need to prepare the following documents:
The application is registered according to Form 15 issued with Decree 151.
Documents on land use rights according to Articles 137, 148, 149 (if any); attached with a diagram of houses and construction works.
Land use right transfer documents or certificates with the increased area (if arising).
Inheritance documents for land use rights in cases of inheritance.
Land allocation documents without proper authority, purchase - liquidation - valuation of houses and works (if in this case).
Documents related to administrative sanctions in the land sector (if any).
Contracts, agreements or decisions of the court on rights to adjacent land plots (if registering for limited use rights).
Documents determining members of the same land use rights for households.
Land map measurement scrap (if there is no map or need to be measured).
Design documents or construction acceptance documents (if there is a construction on the land).
The decision to sanction and the payment document according to Decree 101/2024 for cases of violations that need to be corrected.
Certificate of financial obligations or documents exempted or reduced according to regulations.
Documents for transferring land use rights, houses, and works signed by both parties in case the transaction has not been transferred.
Certificate of eligibility for construction of the project from the district-level construction agency if the project is subject to a permit.
