On August 30, Mr. Le Huu Hoang - Vice Chairman of Khanh Hoa Provincial People's Committee signed a decision to cancel 4 decisions approving land prices.
These are Decisions No. 2116, No. 2133, No. 2151, No. 2161 in August 2024.
The above decisions include the approval of specific land prices to calculate additional land use fees due to adjustments to the architectural planning scheme of the Napoleon Castle I Apartment project at 25-26 Nguyen Dinh Chieu, approval of specific land prices to calculate land use fees and land rent for the Le Hong Phong II New Urban Area project, Phuoc Long New Urban Area, and approval of specific land prices to calculate land rent and annual land rent payments at the land plot at 2 Yersin Street.
The reason for canceling the above decisions is because the decisions issued based on legal documents have expired.
Previously, on August 28, the Department of Natural Resources and Environment of Khanh Hoa province sent a document to the People's Committee of Khanh Hoa province regarding the issuance of specific land price decisions for specific land price application dossiers submitted before August 1, 2024.
Approval of project land prices is the basis for authorities to determine financial obligations before granting land use right certificates to people living in some real estate projects in the area.
There is also a basis for localities to apply land price calculation methods to some real estate projects that do not have land prices after legal changes.
According to the Department of Natural Resources and Environment, the Department submitted 4 land price plan dossiers to the Provincial People's Committee for decision before August 1, 2024. The Provincial People's Committee decided on specific land prices according to the submitted plan without applying the provisions of the 2024 Land Law.
The issuance of 4 decisions by the People's Committee of Khanh Hoa province approving specific land prices according to the documents submitted by the Department of Natural Resources and Environment before August 1, 2024 is in accordance with the provisions of Clause 3, Article 257 of the 2024 Land Law.
However, in the 4 decisions approving specific land prices of the Provincial People's Committee issued after August 1, 2024 (draft of the Department of Natural Resources and Environment submitted for signing before August 1, 2024), the legal basis for issuing the decision was based on the 2013 Land Law and the decrees and circulars guiding its implementation that have expired since August 1, 2024, which is inappropriate and should be cancelled.
Thus, less than 10 days after the 4 decisions approving land prices, Khanh Hoa province decided to cancel the above decisions.
It is also worth noting that, after receiving the decision approving the land price, the investor of the Le Hong Phong II New Urban Area project filed a complaint, disagreeing with the local land price calculation method and requesting a dialogue.
