Mr. Tran Van Hoa's family (residing in Truong Vinh ward) is one of the typical cases of prolonged backlog of dossiers. The family's land plot of more than 2,000m2 has been used stably since before 1980, without dispute. However, in 1996, functional agencies issued a Certificate of Land Use Rights to him on another land plot, not in the actual location.
Over the years, Mr. Hoa has repeatedly submitted dossiers requesting the revocation of the wrongly issued certificate to be re-issued according to the current status of use. Although the dossier has been verified to meet legal conditions, the resolution is still prolonged. The dossier has been returned back and forth through many stages, causing his family to be tired and upset.
Similarly, Mr. Nguyen Quoc Tam (resident of Thanh Vinh ward) fell into a situation that lasted for many years when carrying out procedures related to the land plot originating from 1977. According to Mr. Tam, although he has provided sufficient documents proving the stable land use process through many stages, the dossier has been rejected or requested for supplementation many times, and has not been resolved definitively.
This reality shows that there are many cases where people have to go back and forth many times, complete dossiers as required but still encounter obstacles in the processing process. The reasons are not only due to the complexity of the dossier but also to errors in land management through periods, such as issuing certificates in the wrong location, allocating land ultra vires, incomplete cadastral records or difficulties in determining actual boundaries.
According to the Vinh Regional Land Registration Office Branch, there are currently about 1,000 backlog dossiers for land use right certificates in the old Vinh city. Many dossiers have been verified at the grassroots level but have not been completely processed, prolonged for many years.
Faced with the above situation, leaders of Nghe An province have repeatedly directed localities and functional agencies to urgently resolve administrative procedures on land for people in a timely manner and in accordance with regulations; and at the same time requested resolute handling of cases of delay, avoidance or signs of negativity.
At regular citizen reception sessions, Chairman of the Provincial People's Committee Vo Trong Hai directly presides over, listens to and directs the resolution of many complex and prolonged cases. Through citizen reception sessions, provincial leaders requested a comprehensive review of dossiers, clear verification of land origin, organization of direct dialogues with people and classification of each case for appropriate handling.
For complex cases, the province directed the establishment of an inter-sectoral working group for thorough appraisal, ensuring that the resolution is both in accordance with legal regulations and reasonable and logical. Thanks to that, many long-standing backlogs have been resolved.
However, reality shows that in some places, the progress of resolution is still slow, not meeting the set requirements. This requires functional agencies to continue to improve their responsibility, strengthen coordination and proactively remove obstacles right from the grassroots level.
