Citizens should ask the Ministry of Agriculture and Environment whether individuals who are not directly engaged in agricultural production are eligible for land allocation without land use fees, recognition of land use rights for agricultural land that has not been granted a land use right certificate?
Responding to this question, the Ministry of Agriculture and Environment said:
- For individuals who do not directly use agricultural land, agricultural land not subject to land use fees shall not be allocated, except for individuals who are ethnic minorities and near-poor households in ethnic minority and mountainous areas who are entitled to State policies as prescribed in Point c, Clause 2, Article 16 of the 2024 Land Law.
- In case a household or individual is using land stably for agricultural purposes but that individual does not directly use agricultural land, they will be considered for a Certificate according to the provisions of Clause 6, Article 138 of the 2024 Land Law.
- The limit for agricultural land allocation is stipulated in Article 176 of the 2024 Land Law.
