The Ministry of Agriculture and Environment received a petition from voters in Hai Phong city with the content: Proposing to study and advise the Government to submit to the National Assembly to amend the 2024 Land Law on the order and procedures for site clearance for projects in the direction of simplification, reduction of administrative procedures, and reduction of implementation time (including the time of mobilizing and persuading land users to recover land) to accelerate the progress of site clearance for projects.
Regarding this proposal, the Ministry of Agriculture and Environment has the following opinions: Regarding the simplification and reduction of administrative procedures, reducing the time to implement procedures for site clearance, the Ministry of Agriculture and Environment has advised the Government to submit to the National Assembly for promulgation Resolution No. 254/2025/QH15 dated December 11, 2025, stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, including regulations in points a, b, clause 9, Article 3 as follows:
The order and procedures for compensation, support, resettlement, and land recovery for national defense and security purposes; socio-economic development for national and public interests are stipulated in the Land Law, documents detailing and guiding the implementation of the Land Law and the following regulations:
a) Before issuing a land recovery decision, the competent authority sends a land recovery notice to the person whose land is recovered, the owner of assets attached to the land, and the person with related rights and obligations (if any) to know no later than 60 days for agricultural land and 120 days for non-agricultural land. The time limit specified in this point does not apply to the cases specified in Clause 2, Article 85 of the Land Law;
b) The deadline for publicly posting compensation, support, and resettlement plans at the headquarters of the commune-level People's Committee, common living locations of residential areas where land is recovered, and posting them on the electronic information portal of the commune-level People's Committee is 10 days. The time limit for organizing dialogues in case there are still disagreements about the compensation, support, and resettlement plan is no more than 30 days from the date of organizing the consultation on the compensation, support, and resettlement plan.
