Starting today (August 1), 3 laws including the Land Law, Housing Law and revised Real Estate Business Law will officially take effect.
Experts assess that when the Laws take effect, the legal corridor and real estate market will be much more open.
In particular, the Land Law will have many new regulations related to agricultural land, an issue that many people are quite concerned about.
Mr. Le Van Binh - Deputy Director of the Land Department (Ministry of Natural Resources and Environment) said that in the past, when discussing real estate, we mainly discussed housing, industrial real estate, and land. commercial services. However, through this Land Law, agricultural land use rights will receive more attention.
As with rice land, previously only people who directly produced agricultural land could receive rice land use rights. Currently, according to the law, individuals who do not directly engage in agricultural production, if they have the conditions and are capable of growing rice, can also receive transfer rights.
"Under the condition that if the land allocation exceeds the local land allocation limit, it will be transferred to a competent state agency for approval" - Mr. Binh said, adding that agricultural land will have value.
Many real estate experts also said that agricultural land is an issue that still concerns management agencies.
Currently, people cannot sit still and use farmland just to grow rice when the real estate market is vibrant. Therefore, people have a need to accumulate land, combined with business and production.
Meanwhile, the current problem is that agricultural land is being used wastefully due to abandonment. Hopefully, this revised law will untie agricultural land.
Many experts also highly appreciate the change in the Land Law this time because in the past, people used a combination of rice growing and business with models such as "field cafe" that brought many benefits but had no framework. legally, this is considered an illegal act. However, this Law has legalized that issue on the basis of harmonizing the interests of social actors.
Mr. Nguyen Van Dinh - real estate legal expert said: "People must have a plan to submit to the management agency for strict management when using agricultural land in combination with trade and services. At that time, the interests of subjects and the state will be harmonized. Another problem is how to take measures to collect revenue to ensure the rights and obligations of the people."
