Fine up to 1 billion VND if transferring a real estate project that does not meet the conditions

Decree 339/2026/ND-CP stipulates many new points on the level of penalties for violations in real estate business activities.

The Government promulgates Decree No. 339/2026/ND-CP stipulating penalties for administrative violations in the fields of construction, management of technical infrastructure works, management, housing development, and real estate business. This Decree takes effect from August 26, 2026.

Notably, Article 70 of this Decree stipulates penalties related to violations of investor regulations on real estate project transfer. Specifically:

Article 70. Violation of investor regulations on real estate project transfer

1. A fine of between VND 120,000,000 and VND 180,000,000 shall be imposed for the act of not monitoring and not notifying competent state agencies about violations of the law in land use and construction investment by the transferee.

2. A fine of between VND 600,000,000 and VND 800,000,000 shall be imposed for the act of transferring the entire or part of a real estate project without permission from a competent authority to transfer the entire or part of a real estate project as prescribed.

3. A fine of between VND 800,000,000 and VND 1,000,000,000 shall be imposed for one of the following acts:

a) Transferring the entire or part of a real estate project when the project or part of the transferred real estate project does not meet the conditions and principles as prescribed;

b) Transferring the entire or part of a real estate project not in accordance with the form and scope of business as prescribed.

4. Additional penalty form: Suspension of real estate business activities for 3 months to 6 months for project investors who violate the provisions of Clauses 2 and 3 of this Article.

5. Remedial measures: Forcing the transferee to return the entire amount collected not in accordance with regulations, along with the profit arising from the collected amount for the acts specified in Clauses 2 and 3 of this Article.
