Fees payable when converting agricultural land to residential land

+ Land use fee:

According to the provisions of Clause 1, Clause 2, Article 8 of Decree 103/2024/ND-CP, when converting agricultural land to residential land, land use fees are calculated as follows:

Land use fee when changing land use purpose to residential land

= Land use fee of land type after land use purpose change - Land use fee, land rent of land types before land use purpose change (if any).

+ Red book issuance fee:

Depending on the regulations of 63 provinces and cities, the fee for issuing red books for agricultural land when converting to residential land will be different. The payment level is from 100,000 VND/time of issuance or less.

+ Registration fee:

Registration fee = (Land price in land price list x Area) x 0.5%

Applicable to cases of land use purpose change subject to fee payment. Some cases are exempted from registration fee according to the provisions of the current Land Law.

In addition, land users applying to change the purpose of agricultural land to residential land must pay a fee for document appraisal. This fee depends on each province and city.

Conditions for converting agricultural land to residential land

Households and individuals are allowed to change the purpose of using agricultural land in residential areas, agricultural land in the same plot of land with residential land to residential land if it is consistent with the district-level land use planning or general planning or zoning planning according to the provisions of the law on urban planning approved by competent authorities, this is clearly stipulated in Clause 5, Article 116 of the 2024 Land Law.

No limit on area converted to residential land

According to the provisions of the 2024 Land Law and its implementing documents, the decisions of the People's Committees of provinces and centrally-run cities (provincial level) do not have any provisions regulating the area limit for converting land use purposes to residential land.
