On the Government Portal, Mr. D. C. V in Hanoi said that he is a 1/4 wounded soldier, losing 81% of his strength.
In 1986, he was liquidated by the irrigation department, devaluing the warehouse he had been arranged to live in since 1979 when he was discharged from the army to return to his locality.
The warehouse was built on the foundation of the old brick kiln managed by the locality. In 1987, Mr. V was verified by the local government to have land mortgaged to his family according to the current situation at that time. He applied for approval and confirmed this issue.
Mr. V asked, now that you have registered for a red book, is it applied as another document according to point n, clause 1, Article 137 of the 2024 Land Law? If not, according to which clause of the Land Law is a red book issued?
The Ministry of Agriculture and Environment answers this question as follows:
The content of his reflection is that the specific case is under the jurisdiction of the locality and needs to be based on archived records and specific regulations that the locality has issued according to its authority to enforce the Land Law for consideration and resolution.
Therefore, the Ministry states a number of principles as follows:
Current land law has specifically stipulated the issuance of certificates of land use rights and ownership of assets attached to land for the first time to households and individuals who are using land in Articles 137, 138, 139 and Article 140 of the Land Law.
Clause 1, Article 137 of the Land Law specifically stipulates the types of land use right documents, and at the same time, point n, clause 1, Article 137 of the Land Law stipulates other land use right documents dated before October 15, 1993, as prescribed by the Provincial People's Committee in accordance with local practice.
Based on the above regulations, it is proposed that you study and compare to implement, in cases that do not fall into the cases with papers in Article 137 of the Land Law, you can study and refer to Article 140 of the Land Law to compare regulations and implement.
The Ministry of Agriculture and Environment informed him to know, study, and contact the People's Committee of the commune where the land is located to be guided to resolve it according to their authority.
