Issuance of red books for increased land areas according to Decree 49/2026
The Government issued Decree 49/2026/ND-CP (effective from January 31, 2026) guiding Resolution 254/2025/QH15 stipulating mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.
Supplementing Clause 4, Article 24 of Decree 101/2024/ND-CP stipulating the handling of issuing Certificates of land use rights, ownership of assets attached to land for land plots with increased area due to changes in boundaries compared to land use right documents or Certificates issued as follows:
In case households and individuals have been granted certificates for a part of the land plot area, and the remaining area does not yet meet the conditions for granting certificates according to the provisions of law at the time of granting certificates in the past, but now meet the conditions for granting Certificates of land use rights and ownership of assets attached to land, they are considered for granting Certificates of land use rights and ownership of assets attached to land.
Application for a red book with increased area
Based on Article 24 of Decree 101/2024/ND-CP, dossiers for issuing Certificates for additional areas compared to land use right documents for households and individuals currently using land are divided into many different cases.
- Dossier for issuing a Certificate in case the additional land area has not been granted a Certificate but has land use rights documents in Article 137 of the 2024 Land Law (no additional area) as follows:
+ Application for registration and issuance of Certificate according to Form No. 04/DK for the entire area of the land plot being used.
+ One of the types of land use right documents of the original land plot.
+ Other types of documents under Article 28 of Decree 101/2024/ND-CP.
- Dossier for issuing a Certificate in case the land area increases for the original land plot that has been granted a Certificate.
+ Application for registration of land and asset changes attached to land according to Form No. 11/DK.
+ Original Certificate of original land plot.
+ One of the types of documents related to the content of land and asset changes attached to land for each specific case as prescribed in Article 30 of this Decree.
+ Documents on representation according to the provisions of civil law for cases of carrying out procedures for land registration and assets attached to land through representatives.
