Pursuant to Article 77 of Decree 102/2024/ND-CP, regulations on the implementation of specific agricultural land centration are as follows:
(1) Economic organizations and individuals implementing agricultural land centration shall agree with land users on the following contents:
- Concentration method according to the provisions of Clause 1, Article 192 of the 2024 Land Law for each land user and each land area;
- Time for implementing agricultural land concentration;
- Proportion of land area that land users must contribute to build roads and irrigation in the fields to facilitate the organization of agricultural production;
- Land recovery plan for land users after the end of agricultural land concentration; Land recovery must ensure stability of the concentrated agricultural land use plan;
- Rights and obligations of land users participating in agricultural land concentration for each concentration method;
- Other agreements as prescribed by law.
(2) Economic organizations and individuals implementing agricultural land consolidation must develop a land use plan that includes the following contents:
- Determine the scope, scale, location, and boundary of the agricultural land concentration area;
- Current status of land use includes: area, purpose, form, land use term, land manager, land user;
- Determine the method of organizing agricultural production for the concentrated agricultural land area;
- Proposal to use land for land areas managed by the State in areas with concentrated agricultural land;
- It is expected to complete the transportation and irrigation system in the fields, the regional and plot banks; determine the land area to be converted to traffic and irrigation purposes in the fields.
(3) In case the land use term of the land plot is less than the land use term of the land use plan,:
Land users request competent People's Committees to adjust the land use term to match the land use term of the land use plan;
In the case specified in Point a, Clause 1, Article 172 of the 2024 Land Law, the land user does not have to go through procedures to adjust the land use term.
(4) The land management agency shall submit to the People's Committee of the same level to sign the certificate on the basis of the land use plan approved by the competent authority; award certificates to the granted person; Transfer 01 set of documents enclosed with 01 copy of the certificate issued to the Land Registration Office or Branch of the Land Registration Office to prepare and update the cadastral record, land database.
