Many important changes related to agricultural land
Speaking with Lao Dong, Ms. Doan Thi Thanh My - Deputy Director of the Department of Land Management (Ministry of Agriculture and Environment) said that among the new points of the Land Law related to agricultural land, one of the important changes is to allow individuals who are not directly engaged in agricultural production to receive the transfer of land use rights for rice cultivation. In addition, the law also allows economic organizations to receive land use rights to implement agricultural projects, provided that there must be a land use plan approved by competent authorities.
The second point is that the law clearly stipulates land concentration and land accumulation, especially the permission for combined land use for multiple purposes, this is a fundamental new point.
In addition, according to Ms. My, in this amendment, the law also allows agricultural land users to convert the structure of crops and livestock, and use a certain ratio of land area to serve agricultural production. This is one of the important new points, aiming to create more convenience for people and businesses, especially in the agricultural sector.
The Deputy Director of the Department of Land Management emphasized that when using land in combination with commercial purposes, land users must have a specific plan. Moreover, when changing the purpose of land use, especially changing to a purpose with higher economic value, the land user will have to fulfill financial obligations to the state.
The State has policies to encourage organizations and individuals to concentrate land for agricultural production
According to Article 192 of the 2024 Land Law, the State has a policy to encourage organizations and individuals to concentrate land for agricultural production; apply science and technology to economically and effectively use the concentrated land fund.
Funding for the work of measuring, adjusting cadastral records, issuing Certificates of land use rights, ownership of assets attached to land to carry out land consolidation and plot exchange to concentrate land for agricultural production guaranteed by the state budget.
Economic organizations and individuals performing the concentration of agricultural land must make a land use plan to send to the commune -level People's Committee for monitoring. In case the land use plan that changes the purpose of land use within the agricultural land group, the land user must be agreed upon the return of agricultural land after participating in land concentration. In case of concentration of agricultural land that must adjust the land use right, shall comply with Article 219 of this Law.
