Ms. T.T said that on page 4 of her red book, the revised content is written: "16 m2 has been donated to build traffic roads according to the basic donation of land use rights certified by the People's Committee... on March 24, 2025; the remaining area is 148 m2...".
However, the People's Committee later discovered that the recording of this content was not true to reality, because Ms. T did not donate land for road construction; the above-mentioned donation case belonged to another person with the same name as her.
Ms. T asked, is this case eligible for the Branch of the Land Registration Office to correct the red book according to Clause 1, Article 152 of the 2024 Land Law (errors caused by the land registration agency regarding land plots with errors) or not? Or must it be revoked? Or must it be carried out according to the procedure of canceling registration results of changes according to Section XVI, Appendix I of Decree No. 151/2025/ND-CP (only carried out when there is a decision or judgment from a competent authority)?
The Ministry of Agriculture and Environment answers this question as follows:
Because the content reflected and proposed has not clarified whether she has a need to donate land to build a traffic road or not at the time the Commune People's Committee issued a document to donate land use rights certified on March 24, 2025, the Ministry of Agriculture and Environment has no basis to answer specifically.
The Ministry would like to mention some principles as follows:
In case the presentation of information about land donors has errors, land users are entitled to carry out procedures to correct the red book issued according to the provisions of Clause 1, Article 152 of the Land Law.
In case the area of land recovered for road construction according to the People's Committee's document has errors, the recovery and re-issuance of the red book shall be carried out according to the provisions of point d, clause 2, Article 152 of the Land Law.
The order and procedures when correcting or revoking the red book issued are specified in Section XV, Content C, Part V of Appendix I issued together with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government.
