According to point b, clause 2, Article 14 of Decree 49/2026/ND-CP, the Chairman of the commune-level People's Committee has the authority to:
Issuance of Certificates of land use rights, ownership of assets attached to land or confirmation of changes on the issued Certificate for cases under the decision-making authority of agencies and competent people at commune level.
Accordingly, the Chairman of the Commune-level People's Committee is granted a red book in 8 cases with decisions on:
- Allocate land to households and individuals under the authority of the commune level;
- Leasing land under the authority of the commune level;
- Allowing land use purpose conversion according to the authority of the commune level;
- Adjusting the land use term;
- Extension of land use term;
- Change of land use form;
- Recognition of land use rights;
- Re-determine the residential land area for households and individuals.
The issuance of red books or confirmation of changes on the issued Certificate can only be carried out when the Chairman of the commune-level People's Committee is the person who makes administrative decisions on land in each specific case.
Decree 49/2026/ND-CP also clearly defines the authority to issue red books, avoiding overlap in implementation:
- Provincial-level land management agencies issue red books for cases decided by provincial levels to allocate land, lease land, change land use purposes, extend, adjust land use terms, and recognize land use rights;
- The Chairman of the Commune-level People's Committee issues land use right certificates for cases decided by the commune level;
- The Land Registration Office shall carry out the issuance of red books, first-time land registration, registration of changes in cases not under the authority of the provincial and commune levels.
Also according to Article 14 of Decree 49/2026/ND-CP, which agency has the authority to issue a red book, it also has the authority to:
- Correction of the issued Certificate with errors;
- Revocation and cancellation of the issued Certificate;
- Re-issuance of Certificates of land use rights, ownership of assets attached to land.
Thus, the Chairman of the Commune-level People's Committee also has the authority to handle arising issues related to the red book issued by him in accordance with regulations.
