Based on Section XIV, Part C in Part V, Appendix I issued together with Decree 151/2025/ND-CP stipulating the order and procedures for correcting red books issued but found to have errors as follows:
(1) The submission of documents to correct the issued red book but finding errors is carried out as follows:
- In case the agency or competent person specified in Article 136 of the 2024 Land Law discovers that the issued Certificate has errors, notify the issuer of the Certificate and request to return the original issued Certificate for correction;
- In case the person granted the Certificate discovers that the Certificate is issued for the first time with errors, submit the application according to the regulations in (2) to the One-Stop Shop Department.
- The dossier receiving agency shall implement:
+ Check the completeness of the dossier components and issue a Letter of Receipt and a deadline for returning the results.
In case the dossier components are not complete, return the dossier with the Application Form for Supplement and Completion of the dossier for the applicant to register for completion and supplementation according to regulations.
The dossier receipt and result return appointment and the Application Form for supplementation and completion of dossiers shall be implemented according to the form specified in the Government's Decree on the implementation of the one-stop shop mechanism, inter-agency one-stop shop in resolving administrative procedures.
+ Transfer dossiers to agencies with land management functions;
- In case the person granted the Certificate discovers that the Certificate issued when carrying out procedures for registering land changes and assets attached to land has errors, submit the dossier according to the provisions of Section 2 of Part XIV to the One-Stop Shop Department or the Land Registration Office or the Branch of the Land Registration Office.
The dossier receiving agency shall implement:
- Check the completeness of the dossier components and issue a Letter of Receipt and a deadline for returning the results.
In case the dossier components are not complete, return the dossier with the Application Form for Supplement and Completion of the dossier for the applicant to register for completion and supplementation according to regulations.
The dossier receipt and result return appointment and the Application Form for supplementation and completion of dossiers shall be implemented according to the form specified in the Government's Decree on the implementation of the one-stop shop mechanism, inter-agency one-stop shop in resolving administrative procedures.
- In case the dossier receiving agency is the One-Stop-Shop Department, transfer the dossier to the Land Registration Office.
(2) Dossiers submitted when carrying out procedures to correct the issued Certificate for cases where land users and owners of assets attached to land discover that the issued Certificate has errors include:
- Application for registration of land changes and assets attached to land according to Form No. 18 issued together with this Decree;
- Original Certificate issued;
- Documents proving information errors of the person granted the Certificate compared to information at the time of requesting correction or information errors about land plots and assets attached to land compared to information on the issued Certificate;
- In case land users and owners of assets attached to land carry out procedures through representatives according to the provisions of civil law, they must have a document on authorization according to the provisions of civil law.
(3) In case the First-time Certificate is issued with errors, the agency with land management functions shall perform:
- Notify the Land Registration Office to transfer the dossier for issuing the Certificate to the agency with land management functions;
- Checking records, making minutes of conclusions on the content and causes of errors;
- Submit to the agency or competent person specified in Clause 1, Article 136 of the Land Law to confirm the correction content on the Certificate of issued or newly issued Certificate of land use rights, ownership of assets attached to land;
- Transfer dossiers to the Land Registration Office for adjustment and update of changes in cadastral records, land databases; award Certificates of land use rights, ownership of assets attached to land or send them to the dossier receiving agency to be awarded to the issuer.
(4) In case the Certificate issued when carrying out procedures for registering land changes and assets attached to land has errors, the Land Registration Office shall perform:
- Inspect and make a record of conclusions on the content and causes of errors;
- Confirm the content of correction on the Certificate issued or newly issued Certificate of land use rights, ownership of assets attached to land;
- Adjust and update changes in cadastral records, land databases; award Certificates of land use rights, ownership of assets attached to land or send them to the dossier receiving agency to be awarded to the issuer.
