Based on Section VI, Part C in Part V, Appendix I issued with Decree 151/2025/ND-CP and point a, clause 6, Article 7 of Decree 226/2025/ND-CP stipulating the order and procedures for registering land changes, assets attached to land and issuing Certificates of land use rights, ownership of assets attached to land as follows (except for cases specified in Parts I, VII, VIII, IX, X, XI, XII, XIII of "PART C. PROCEDURES FOR REGISTRATION OF LAND AND ASSETS ATTACHED TO LAND"):
(1) The applicant submits 1 set of documents including the following documents:
- Application for registration of land changes and assets attached to land according to Form No. 18 issued together with Decree 151/2025/ND-CP.
- Certificate issued.
- One of the types of documents related to the content of land changes, assets attached to land for each specific case.
- Document on representation according to the provisions of civil law for cases of carrying out procedures for registering land and assets attached to land through representatives.
In case the handling of collateral and capital contributions with land use rights and assets attached to land is not in accordance with the agreement; the seizure and auction of land use rights and assets attached to land for judgment enforcement according to the provisions of law, the submission of dossiers is carried out by the organization implementing the handling of land use rights and assets attached to land or by the land user, owner of assets attached to land.
(2) The dossier receiving agency shall implement:
- Check the completeness of the dossier components, issue a Letter of Receipt for the dossier and schedule a return of the results.
In case the dossier components are not complete, return the dossier with the Application Form for Supplement and Completion of the dossier for the applicant to register for completion and supplementation according to regulations.
The dossier receipt and result return appointment, Application form for supplementation and completion of dossiers shall be implemented according to the form specified in the Government's Decree on the implementation of the one-stop shop mechanism, inter-agency one-stop shop in resolving administrative procedures;
- In case the dossier receiving agency is the One-Stop-Shop Department, transfer the dossier to the Land Registration Office.
In case of re-determining the residential land area according to Clause 6, Article 141 of the 2024 Land Law, the dossier receiving agency shall transfer the dossier to the agency with land management functions at the commune level.
(3) The Land Registration Office shall perform the following tasks:
- Inspect the conditions for exercising rights according to the provisions of the 2024 Land Law for cases of exercising rights of land users and owners of assets attached to land; in cases where they do not meet the conditions for exercising rights according to the provisions of the 2024 Land Law, the Land Registration Office shall notify the reason and return the dossier to the applicant;
- When resolving procedures for registering land changes where the land plot has been granted a Certificate according to the cadastral map or extracted from the cadastral map of the land plot, the Land Registration Office does not have to carry out measurement or re-determination of the land plot area, except in cases where land users, owners of assets attached to land have a need...
- Send the Information Transfer Slip to determine financial obligations to land according to Form No. 19 issued together with Decree 151/2025/ND-CP to the tax authority to determine and notify financial obligation collection for cases where financial obligations must be fulfilled in accordance with the law;
- Adjusting and updating changes in cadastral records, land databases; issuing new Certificates of land use rights, ownership of assets attached to land or confirming changes on the issued Certificate for cases where they do not have to fulfill financial obligations; issuing Certificates of land use rights, ownership of assets attached to land or sending dossiers to the receiving agency for issuance to the issuer.
For cases where financial obligations must be fulfilled, the Land Registration Office shall perform the tasks specified in this point when there is information from the interconnected database or documents or papers proving that financial obligations have been fulfilled.
