According to the 2024 Land Law and its implementing guidelines, land registration and issuance of Land Use Rights Certificates are carried out according to the principle of consistency, ensuring strict management and full updating of legal information of land plots and assets attached to land. However, the law also clearly stipulates that when certain changes arise, it is necessary not to continue using the issued red book but to carry out procedures for reissuing or reissuing the certificate.

Recently, the Ministry of Agriculture and Environment issued Consolidated Document No. 83/VBHN-BNNMT dated December 9, 2025, consolidating regulations on basic land investigation, land registration, issuance of certificates and land information systems. This document consolidates the content of Decree No. 101/2024/ND-CP, Decree No. 151/2025/ND-CP and Decree No. 226/2025/ND-CP of the Government, creating a unified legal basis for the issuance, re-issuance and re-issuance of red books.

According to current land law, in some cases, registration of changes is not only confirmed on the issued red book but the land registration agency must carry out procedures for reissuance or reissuance of certificates.

According to current regulations, the issuance of new red books is applied when the land plot or legal content of the land plot changes fundamentally, such as in the case of an investment project using land to adjust the detailed construction planning; or the investor has been granted a red book for the entire land area of the project but needs to issue a book for each land plot according to the approved planning.

The new red book is also issued in the case of certifying the ownership of assets attached to land for a plot of land with a previous Certificate. The new granting is also subject to when all information about the land plot changes due to measurement and cadastral maps; or the residential land area changes due to re-determination according to the provisions of the land law.

In addition, during the registration of changes in land use rights and ownership of assets attached to land, if the issued certificate no longer has an empty space to confirm the change, or the land user or property owner needs to reissue the certificate, the land registration agency will carry out the procedures for reissuance according to regulations.

According to regulations, land use right certificates are issued according to the Land Law and decrees guiding the use of certificate codes managed by the Ministry of Agriculture and Environment uniformly nationwide, and are issued through the software of the National Land Information System, ensuring consistency, transparency and unity in management.
