Pursuant to Part 2 of the List of procedures issued with Decision 3380/QD-BNNMT in 2025, the procedure for reissuing a Land Use Rights Certificate (red book) due to loss will be applied from August 25, 2025 with specific amendments and supplements as follows:
(1) Procedures for reissuing red books due to loss from August 25, 2025
Step 1: Applicants submit their application to one of the following locations in the province:
The Public Administration Service Center or the Land Registration Office or Branch of the Land Registration Office.
Step 2: The dossier receiving agency implements:
- Check the completeness of the dossier components and issue a dossier receipt and schedule a return of results.
- In case the Public Administration Service Center receives the dossier, the dossier shall be transferred to the Land Registration Office or Branch of the Land Registration Office.
Step 3: The Land Registration Office, Branch of the Land Registration Office shall:
- Check information about the issued Certificate that the land user or owner of the property attached to the land declared missing in the cadastral records and land database.
- Post 3 times on local mass media within 15 days in cases of loss of Certificates of organizations, people of Vietnamese origin residing abroad, foreign organizations, and foreign individuals; the cost of posting is paid by land users and owners of assets attached to land.
- Transfer information to the People's Committee of the commune where the land is located in case of loss of the Certificate of an individual or residential community.
Step 4: The People's Committee of the commune where the land is located shall:
- Publicly post the loss of the issued Certificate at the headquarters of the People's Committee at the commune level and the residential area where the land is located within 15 days; at the same time, receive feedback during the time of public posting about the loss of the issued Certificate.
- Make a record of the termination of posting within no more than 5 days from the date of termination of posting and send it to the Land Registration Office, Branch of the Land Registration Office.
Step 5: The Land Registration Office, Branch of the Land Registration Office shall:
- Cancel the issued Certificate; update and edit cadastral records and land databases; reissue the Certificate to the granted person.
- Check and approve the cadastral map extract submitted by the land user in cases where the land user needs to re-measure to re-determine the size of the edges and area of the land plot.
- Record a cadastral map or extract a cadastral map of a land plot for a place without a cadastral map or only a paper cadastral map that is torn, damaged, cannot be restored and cannot be used for digitization...
(2) Forms of submission when reissuing lost red books
- Submit directly to the Public Administration Service Center or the Land Registration Office or Branch of the Land Registration Office.
- Pay via postal service.
- Submit online on the Public Service Portal.
- Submit at the location agreed upon between the registration ungender and the Land Registration Office, Branch of the Land Registration Office.
(3) Components and quantity of lost documents when reissuing the red book
Component of the dossier:
- In case of reissuance of lost red books:
+ Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree 151/2025/ND-CP.
+ Land plot cadastral map extracts for cases where land users need to measure to re-determine the size of the edges and area of the land plot.
- In case of loss of the Supplementary page:
+ Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree 151/2025/ND-CP.
+ Certificate issued.
+ Land plot cadastral map extracts for cases where land users need to measure to re-determine the size of the edges and area of the land plot.
Number of documents: 1 set.
(4) Deadline for handling procedures for reissuing red books due to loss
- No more than 10 working days from the date of receipt of complete and valid documents.
- For mountainous communes, islands, remote areas, areas with difficult or especially difficult socio-economic conditions: the settlement period is not more than 20 working days.
