Citizens sent their questions to the Ministry of Agriculture and Environment questioning that the locality has completed the cadastral survey. However, the project has ended, and some households have not been granted land use right certificates after plotting to change plots. Citizens ask how the authority to issue certificates after land exchanges for individual households is?
Responding to this question, the Ministry of Agriculture and Environment said that Clause 1, Article 192 of the 2024 Land Law stipulates that one of the methods of concentrating agricultural land is to convert the right to use agricultural land according to the plan of consolidating fields and exchanging plots.
Article 77 of Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law stipulates the implementation of agricultural land centration. Accordingly, the competent land management agency shall submit to the People's Committee of the same level to sign and issue Certificates to economic organizations and individuals implementing agricultural land concentration on the basis of a land use plan approved by the competent authority.
At point b, clause 1, Article 136 of the Land Law, it is stipulated that the People's Committees at the district level issue Certificates of land use rights and ownership of assets attached to land to households and individuals, and at point h, Clause 1, Article 5 of Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government has transferred the authority to issue the first Certificate to the Chairman of the People's Committee at the commune level for implementation.
The Ministry of Agriculture and Environment recommends that citizens contact local land management agencies for guidance and resolution in accordance with the provisions of law.
