Who is allowed to lease agricultural land?
Pursuant to Article 120 of the 2024 Land Law, the State currently leases agricultural land in two forms: annual land lease and one-time land lease. The subjects eligible for agricultural land lease include:

Authority to lease agricultural land
Pursuant to Article 123 of the 2024 Land Law, the authority to lease agricultural land belongs to the following entities:
- Provincial People's Committees have the authority to lease land to domestic organizations; religious organizations, affiliated religious organizations; people of Vietnamese origin residing abroad, economic organizations with foreign investment capital and foreign organizations with diplomatic functions.
- District People's Committees have the authority to lease land to individuals and residential communities.
- In case of leasing land to individuals for commercial and service purposes with an area of ≥ 0.5 ha: Must have written approval from the Provincial People's Committee before making a decision.
- The People's Committee at the commune level has the authority to lease land from the agricultural land fund for public purposes of the commune, ward, or town.
