In item III of the land plot diagram, house and other assets attached to the land in the Certificate issued in 2023 of Mr. P.L. T's house, it shows that there is a traffic road passing through the house.
Recently, Mr. T requested to provide the latest planning of the land plot at the Land Registration Office, and the result was that the land plot of his house no longer has a traffic road crossing it.
Mr. T asked, in this case, is he entitled to apply for a new Certificate to be reissued so that the locality can update the land plot diagram that no longer has a traffic road crossing it according to the latest plan? And what documents were submitted?
The Ministry of Agriculture and Environment answers this question as follows:
Due to the lack of complete information, dossiers and accompanying documents, the Ministry of Agriculture and Environment has no basis to answer specifically. The Ministry informed you of some provisions of land law as follows:
Clause 1, Article 133 of the Land Law stipulates that registration of changes is carried out in cases where a Certificate has been issued but there are changes. This includes changes regarding the restrictions on the rights of land users.
Clause 6, Article 23 of Decree No. 101/2024/ND-CP dated July 29, 2024 of the Government stipulates basic land investigation; registration and issuance of Certificates of land use rights, ownership of assets attached to land and the Land Information System has stipulated cases of registration of changes in land use rights, ownership of assets attached to land where land users, owners of assets attached to land have a need, a new Certificate of land use rights, ownership of assets attached to land is issued.
Thus, in case the boundary markers, planning boundary markers, boundary markers, safety protection corridor boundary markers on the land plot are expressed by interspersed dashed lines accompanied by notes on the type of boundary markers, boundary markers on the land plot diagram of the Certificate change, it falls under the case of registration of changes.
If land users need a new Certificate when carrying out the above procedures, they will be issued a new Certificate. The order, procedures, and dossiers are implemented according to regulations issued by the People's Committee of Khanh Hoa province.
