Procedures for issuing red books for the first time
Step 1. Submit application.
Pursuant to Point a, Clause 1, Article 21 of Decree 101/2024/ND-CP, the place to submit documents for the first issuance of a Red Book is the One-Stop Department according to regulations of the People's Committee of the province where have land.
Step 2. Receive documents.
Case 1: Missing documents.
If the documents are still missing or the documents are not valid, the submitter must be notified and instructed to supplement the documents.
Case 2: Documents are sufficient.
If the dossier is complete, the agency receives the dossier, makes an appointment to return the results and transfers the dossier to the commune-level People's Committee.
Step 3. Confirm land status.
After receiving the application, the Commune People's Committee confirms the current status of the land with or without housing/construction and whether the land is in dispute or subject to planning.
In addition to confirming the current status of the land, the Commune People's Committee also confirms relevant legal documents depending on each case specified in Clause 2, Article 33 of Decree 101/2024/ND-CP
Step 4. Measure and verify the cadastral measurement extract.
- In case there is already a cadastral map: Provide an extract of the cadastral map.
- In case there is no cadastral map: The land registration office conducts cadastral measurements of the land plot or re-checks the cadastral measurement submitted by the land user.
- Implementation time: no more than 5 working days.
- Measurement costs: Paid by the land user.
- The land registration office checks registration documents; Verify on-site (if necessary) then confirm whether or not you are eligible for a Land Use Rights Certificate in the registration application.
Step 5. The applicant fulfills financial obligations.
In this step, people only need to note the following issues:
- Types of fees payable: Certificate issuance fee, land use fee (if any), registration fee, dossier appraisal fee (if any).
In case one of the above fees is exempted or reduced, it is necessary to prepare documents proving the exemption or reduction of that financial obligation.
- When payment is complete, you must keep invoices and documents to confirm the fulfillment of financial obligations and bring them with you to present when receiving the Certificate.
Note: The Book will only be received when all fees have been paid, except in the case of debiting land use fees.
Step 6. Return results and receive back the Certificate.
Resolution time
Previously, according to Clause 40, Article 2 of Decree 01/2017/ND-CP, the processing time for the first case of issuing a red book was no more than 30 days from the date of receiving a valid dossier.
However, from August 1, 2024, the time for issuing red books will be shortened compared to previous regulations. Accordingly, the time to register land and assets attached to land for the first time is no more than 20 days; The time to issue the first Certificate is no more than 3 working days according to Article 22 of Decree 101/2024/ND-CP.
Thus, the total time from submitting the application until receiving the Certificate will be no more than 23 working days.
