According to Decision 629/QD-BTNMT dated April 3, 2025, the Ministry of Agriculture and Environment has announced the process of standardizing procedures for registration of changes in land use rights and ownership of assets attached to land for cases of transfer, inheritance, donation, capital contribution, lease... not following the plan of land consolidation.

Documents and place of submission

The requester submits a set of documents to the receiving agency. Individuals, communities, and people of Vietnamese origin residing abroad must submit to the One-stop Department or the Land Registration Office. Domestic/foreign organizations, religious organizations, and economic organizations with foreign investment capital pay at similar locations according to regulations.

In case the property is being processed due to mortgage, judgment enforcement seizure, the dossier is submitted by the processor or the land user right recipient.

Receiving and processing documents

The reception agency is responsible for checking the composition of the dossier, the unification of information and the receipt of the receipt, the appointment of the results. If the application is incomplete, not under the authority or information deviation, return it to the submission. The file was then transferred to the land registration office.

Handling at the Land Registration Office

This agency checks the conditions for exercising land use rights. If the conditions are not met, the application will be returned and the reason will be stated. In case the land plot has a cadastral map or measurement, there is no need to re-measure unless the land user requests.

If there is no cadastral map or paper map that cannot be used, a survey will be conducted to show the land plot diagram on the Certificate. Land users must bear the cost of measurement, and if the actual area increases, they must pay the land use fee or rent the increased land.

The Land Registration Office will send the information transfer sheet to the tax authority to determine the financial obligations, update the fluctuations into the cadastral, new grant or confirm changes on the Certificate, and hand over the certificate to the land users. If it is sublease in the project, it will be new to the lessee and confirm the investor's certificate.

If there is a financial obligation, the above steps will only be implemented after the tax authority confirms that the obligation has been fulfilled.

Special case

If in the process of handling, the requester stops the procedure, the related person may continue if it proves the rights. If the continued person is not identified, the land registration office updates the information in the cadastral book.

If receiving documents such as land dispute notices, property seizures, etc., the agency will temporarily suspend the procedure. After having a dispute resolution conclusion or a document allowing continued, the procedure will be resolved.
