Ho Chi Minh City clarifies the application of a maximum bonus mechanism of 50 million VND for households and individuals who hand over land before the deadline when the State recovers land.

The Ho Chi Minh City Department of Agriculture and Environment has just issued an urgent document to the People's Committees of wards, communes and special zones on the unified implementation of a bonus mechanism for people whose land is recovered and handed over before the deadline.

According to Decision No. 11/2026/QD-UBND of the Ho Chi Minh City People's Committee regulating compensation, support and resettlement when the State recovers land in the city, in case the entire land is recovered, households and individuals are rewarded a maximum of no more than 50 million VND/household.

For organizations (excluding state agencies and administrative and non-business units), the maximum bonus is 100 million VND/organization.

In case only a part of the land area belonging to the project is recovered, the bonus level is 50% compared to the above regulations. Households and individuals can receive a maximum of 25 million VND, while organizations can receive a maximum of 50 million VND.

The Ho Chi Minh City Department of Agriculture and Environment said that the 2024 Land Law and current guiding documents do not specifically stipulate the time limit for people to hand over land when the State recovers land according to Article 78 and Article 79 of the law.

Instead, the time of land handover will be determined by the unit or organization performing the compensation, support, and resettlement tasks in the compensation, support, and resettlement plan.

This time milestone must also be clearly shown in the compensation, support, and resettlement plan approved by competent authorities and notified to land users whose land is recovered. This will be the basis for considering the application of bonus policies for cases of land handover before the deadline.

To ensure uniform implementation throughout the area, the Ho Chi Minh City Department of Agriculture and Environment requests the People's Committees of wards, communes, and special zones to proactively survey and assess the actual situation of each project to determine a suitable time for site handover.

At the same time, this time milestone must be specifically expressed in the approved compensation, support, and resettlement plan and plan, and at the same time publicly, clearly, and transparently announced to people whose land is recovered.

According to the Ho Chi Minh City Department of Agriculture and Environment, clearly determining the time of site handover will be the basis for assessing which cases are handed over ahead of schedule, thereby considering applying the bonus mechanism as prescribed in Clause 7, Article 111 of the 2024 Land Law and Article 14 of Decision No. 11/2026/QD-UBND of the Ho Chi Minh City People's Committee.
