Ho Chi Minh City People's Committee has just issued a decision to decentralize the Chairman of the Commune-level People's Committee to perform 26 tasks in the field of land according to Clause 1, Article 14 of Decree No. 49/2026/ND-CP of the Government.

The decentralization aims to increase proactiveness for grassroots authorities, shorten the time to resolve administrative procedures, and at the same time improve the efficiency of state management of land.

Notably, the Chairman of the Commune-level People's Committee is allowed to decide on land allocation, land lease, and permit land use purpose conversion for individuals; allocate land to residential communities and allocate agricultural land to individuals according to the provisions of the Land Law.

In addition, the Chairman of the Commune-level People's Committee is also allowed to decide on land recovery in cases under his authority; issue land recovery notices; decide on mandatory inventory; decide on coercive inventory, coercive land recovery; establish a Board for coercive land recovery and approve the coercive plan.

In compensation, support and resettlement work, the Chairman of the Commune-level People's Committee is allowed to decide to establish a Compensation, Support, and Resettlement Council for each project; approve compensation, support, and resettlement plans; decide on land prices to calculate land use fees in the resettlement area as well as land prices for compensation in some cases as prescribed.

In addition, the Chairman of the Commune-level People's Committee is also assigned the authority to decide on specific land prices; establish a Land Valuation Council; organize the implementation of determining specific land prices; decide on land use right auctions, approve starting prices and recognize winning auction results for cases under its authority.

For the field of land use, the Chairman of the commune-level People's Committee is allowed to consider, approve or not approve the multi-purpose land use plan of individuals; approve the agricultural land use plan of economic organizations; approve the rice land use plan of individuals; approve the plan to contribute land use rights, adjust land to implement projects to renovate and develop rural residential areas and expand and upgrade rural roads.

The decision also assigns the Chairman of the Commune-level People's Committee to perform tasks related to land requisition, determining the level of compensation for damage caused by land requisition, approving coercive plans to implement decisions to resolve land disputes and some other tasks according to the provisions of the Land Law and guiding decrees.

The Chairman of the Commune-level People's Committee is responsible for properly performing the assigned tasks and powers and is responsible to the Ho Chi Minh City People's Committee as well as to the law for the results of implementation.

Periodically, the Chairman of the Commune-level People's Committee must evaluate and report the results of the implementation of assigned tasks to the Ho Chi Minh City People's Committee through the Department of Agriculture and Environment.

Meanwhile, the Ho Chi Minh City Department of Agriculture and Environment is responsible for professional guidance; inspecting and examining the implementation of decentralization; and at the same time summarizing and reporting to the Ho Chi Minh City People's Committee on the results of implementation.
