According to Decision 2304/QD-BNNMT on administrative procedures in the land sector under the state management scope of the Ministry of Agriculture and Environment, there are 32 administrative procedures on land under the authority of the provincial level, effective from July 1, 2025.
In these 32 procedures, there are many procedures related to granting certificates of land use rights and ownership of assets attached to land (red books) such as registration and granting certificates for land plots with increased areas due to changes in boundaries compared to the issued Certificate; Registration and granting certificates for individuals and households that have been granted a Certificate of part of the area to residential land before July 1, 2004, the remaining area of the land plot has not been granted a Certificate;
Issuing and exchanging Certificates of land use rights and ownership of assets attached to land; Reissuing Certificates due to loss; correcting issued Certificates; Revoking Certificates issued incorrectly in accordance with land law by land users and owners of assets attached to land who discover and reissue Certificates after revocation.
The provincial level also conducts registration and issuance of Certificates for cases where land use rights have been transferred before August 1, 2024 but the transferee has been granted a Certificate but has not yet carried out the procedures for transferring rights according to regulations; Registration and issuance of Certificates of land use rights and ownership of assets attached to land to transferees of land use rights, ownership of houses and construction works in real estate projects;
Register and issue Certificates for households and individuals who are using land for purposes other than those recognized by the State for land use rights before July 1, 2014; Register and issue Certificates for cases of transfer of investment projects using land.
In addition, the provincial level also carries out the following procedures: First land registration in cases where the State allocates land for management; Eliminate land lease and sublease registration in infrastructure construction and business projects; Separate or consolidate land plots; Providing information and land data; Appraisal and approval of land use plans; Resolve land disputes under the authority of the Chairman of the Provincial People's Committee; Eliminate debts on land use fees and registration fees on the issued Certificate.
