Commune-level People's Committees have the authority to issue red books
According to the provisions of Clause 1, Article 5 of Decree 151/2025/ND-CP, the Chairman of the People's Committee at the commune level will have the authority to issue a Certificate of Land Use Rights (also known as a red book) to domestic individuals, overseas Vietnamese who are Vietnamese citizens and the community from July 1, 2025.
In addition, the People's Committees at the commune level are also transferred other powers such as:
- Decision approving compensation, support, and resettlement plan
- Approving the enforcement plan for the decision to reclaim land and funding for enforcement activities
- Decision on specific land prices
- Decision on resettlement housing sale price in the area
Procedures for issuing red books for the first time have been shortened
According to the provisions of Sub-section II, Section A, Part V, Appendix I of Decree 151/2025/ND-CP, the time for implementing the procedure for granting the first red book includes: The time for registering land and assets attached to land for the first time is not more than 17 working days. The time for issuing the first Certificate of Land Use Rights and Property Ownership Rights attached to land is no more than 3 working days.
Previously, Clause 1, Article 22 of Decree 101/2024/ND-CP stipulated that the time for initial registration of land and assets attached to land could be up to 20 working days, the time for granting a Certificate did not exceed 3 working days.
Thus, the procedure for issuing a first red book can be shortened to 3 days.
Submitting documents to units in the same province
Previously, people were only allowed to submit their land registration documents to the competent authority where the land was located.
However, according to Clause 1, Article 18 of Decree 151, if submitting the dossier as prescribed in Clause 3 and Clause 4, Article 21 of Decree No. 101/2024/ND-CP (including the dossier for initial registration of land and assets attached to land; registration of changes in land and assets attached to land), people have the right to choose the place to receive the dossier at any unit in the same province/city.
No need to confirm land in accordance with planning, no disputes, stable use
According to the provisions of Clause 4, Article 18 of Decree 151, the People's Committees at the commune level, when carrying out procedures for granting Certificates of land use rights and ownership of assets attached to land, do not have to confirm the compliance with the planning alone, do not dispute, and land is used stably.
This regulation helps people carry out procedures for granting red books more quickly and easily.
