According to Decree No. 151/2025/ND-CP, regulating the division of authority between local authorities at two levels, decentralization of authority, decentralization in the land sector of the Government, from July 1, 2025, the Chairman of the People's Committee at the commune level will have the authority to issue certificates of land use rights and ownership of assets attached to land for the first time to the people.
The Decree also stipulates that the time for carrying out the first registration of land and assets attached to land is no more than 17 working days; the first issuance of a certificate is no more than 3 working days.
The order and procedures for granting red books are stated in Appendix I issued with this Decree.
Accordingly, in case a household, individual, community, or person of Vietnamese origin residing abroad has issued a notice confirming the results of land registration and assets attached to land and needs to issue a red book, the land user shall submit a notice confirming the results of land registration, assets attached to land and the application for land registration, assets attached to land according to Form No. 15 issued with this Decree to the one-stop department.
The dossier receiving agency shall forward the dossier to the People's Committee of the commune where the land is located.
Next, in the case of notification of confirmation of land registration results and assets attached to land showing eligibility for granting red books and at the time of issuance of books not falling under the cases specified in Point d and e, Clause 1, Article 151 of the 2024 Land Law, the competent land management agency at the commune level shall send a transfer form to determine financial obligations for land according to Form No. 19 issued with this Decree to the tax authority so that the tax authority can determine and notify the collection of financial obligations for land users and owners of assets attached to land.
In case the notification of confirmation of the results of land registration and assets attached to land does not show that it is eligible for a red book, the competent land management agency at the commune level shall carry out the tasks specified in Points b, c, d, dd, e and g, Section 3, Part II of "Part C. Procedures for land registration and assets attached to land" of this Decree.
After that, the People's Committee at the commune level will issue red books according to regulations.
