The draft land price table in Ho Chi Minh City is of great interest to the people, businesses, and real estate investors. The reason is that the land price of the draft land price table adjustment is generally increased by 10-20 times compared to the land price of the current land price table, which has been stipulated in Decision No. 02/2020/QĐ-UBND dated January 16, 2020, of the People's Committee of Ho Chi Minh City.
According to the explanation from the leaders of the Department of Natural Resources and Environment, the land price of the draft land price table adjustment is also only about 70% of the land price on the market.
Up to the present time, only Ho Chi Minh City has announced information about the draft land price table adjustment and was explained by the Department of Natural Resources and Environment as the city must strictly implement the regulations at Clause 1, Article 257 of the 2024 Land Law, so it must develop the draft land price table adjustment.
Therefore, Mr. Le Hoang Chau, Chairman of the Ho Chi Minh City Real Estate Association (HoREA), said that, in the content of Clause 1, Article 257 of the 2024 Land Law, as understood by the Association, is to allow the application of the land price table issued by the People's Committee of the province according to the regulations of the 2013 Land Law and the land price adjustment coefficient according to the relevant laws.
Accordingly, the regulations at Clause 3, Article 18 of Decree 44/2014/NĐ-CP and Decree 45/2014/NĐ-CP also allow for continued application until December 31, 2025, and in case of necessity, the People's Committee of the province decides to adjust the land price table according to the regulations of the 2024 Land Law, suitable to the actual situation of land prices at the local level, which may be adjusting the land price table at one location or several locations or all locations.
Mr. Le Hoang Chau said that at present, all files for calculating land use fees when the State recognizes the right to use land for residential purposes or allows the change of land use from agricultural land, non-agricultural land not for residential purposes to residential land for the excess area of land used for residential purposes exceeding the limit of land allocated for residential purposes by the People's Committee of Ho Chi Minh City are all stopped at the Tax Agency to wait for the decision of the competent authority on whether to issue the adjusted land price table and the time of application (if any).
Therefore, the Association requests the Standing Committee of the National Assembly to consider explaining the law regarding the content of Clause 1, Article 257 of the 2024 Land Law related to the land price table, so that localities can have a unified understanding, easy to implement, and for people to be calm and have more than a year to prepare their finances and complete the procedures for obtaining a Certificate of Land Use Rights.
