Buying and selling land without a red book can be fined up to 100 million VND, according to Decree 123/2024/ND-CP.
Specifically, Decree 123/2024/ND-CP on administrative sanctions for violations in the field of Land stipulates strict penalties for the act of transferring land without legal documents. Based on the nature and subject of the violation, the penalties are divided as follows:
For individual violators: Fine from 30,000,000 to 50,000,000 VND.
For violating organizations: Fine from 60,000,000 to 100,000,000 VND.
Decree 123/2024/ND-CP officially takes effect from October 4, 2024, replacing the previous Decree 91/2019/ND-CP. This regulation aims to increase deterrence, protect the legitimate rights of people and ensure order in land management.
Land transactions without a land use right certificate (red book) pose many risks to buyers, including the risk of losing assets, legal disputes or not having land use rights recognized by law. Therefore, people need to be careful and only conduct land transactions when they have complete legal documents.
To avoid violations, experts recommend that people carefully check the legality of the land, contact authorities to verify information, and conduct transactions at notary offices or competent authorities.
Decree 123/2024/ND-CP not only imposes heavy fines but also demonstrates the State’s determination to raise awareness of land laws. Violations, including illegal subdivision and sale of land, encroachment on public land or illegal land transfers, will be strictly handled.
People need to proactively learn about legal regulations, ensure that land transactions are carried out in accordance with procedures and legally, in order to protect their own rights and contribute to building a transparent and healthy real estate market.

The change of land use purpose must be permitted by the competent state agency and must have a legal Land Use Right Certificate. Therefore, before changing the land use purpose, the land user must complete the procedures for granting the Land Use Right Certificate and request permission from the competent agency according to regulations."
