I built a house with an area of 86.4 m2, 3 floors high on rural land in the village, the land use right certificate is in my name. I have submitted enough dossiers and documents to apply for a construction permit. However, the commune still informed me that I was missing the experience declaration of the design organization and individual, and the business registration certificate of the company. While in the first application round, I was asked to supplement the company's capacity dossier and design certificate, and I have now supplemented them fully.
I built a small house on my own land plot to live in, but applying for a construction permit must go through many steps and costly. I had to hire a design unit to prepare detailed design drawings with a cost of nearly 80 million VND, while I only wanted to build a normal tube house and ask a mechanic to design it. However, the commune requires detailed functional designs to be granted a construction permit. So I would like to ask, what documents are needed for a 3-story house like the one above to be granted a construction permit?
Answering this question, after research, the Department of Economics - Construction Investment Management has the following opinion:
According to the provisions of point b, clause 2, Article 9 of Decree No. 06/2021/ND-CP dated January 26, 2021, "for individual houses of households and individuals under 7 floors or with 1 basement, except for the cases specified in point a of this clause, the design must be carried out by organizations and individuals with sufficient capacity according to the provisions of law". It is requested that citizens seriously implement it.
Dossiers requesting new construction permits for individual houses are specified in Clause 1, Article 95 of the 2014 Construction Law and are specified in Article 58 of Decree No. 175/2024/ND-CP. Accordingly, there is no regulation requiring the submission of dossiers related to "declaration of experience of design organizations and individuals, business registration certificate of the company" or "company capacity, design certificate" as mentioned by the citizens.
