Most homeowners cannot complete construction permit documents themselves
According to regulations, it only takes 10-15 working days to get a license to build an individual house, but when asked, many people were moved and held their heads sighed because they encountered too many problems and worries.
Mr. Nguyen Hung (name changed), residing in District 7 (HCMC), said that before the Lunar New Year, he submitted an application for a house construction permit on a plot of land belonging to a project in District 8. Although he hired a large design company to do the painting, when submitting the documents, the district officials informed him that the painting was not in accordance with the construction targets and the requirements for editing.
For nearly two months, Mr. Hung has supplemented the documents many times but still has not completed the procedures. Finally, following a suggestion from a friend, he was forced to go to the service and was introduced to the list of consulting units. After spending a few tens of millions of VND to re-draw the painting, the documents were approved.
Mr. Nguyen Ninh, an architect (KTS) specializing in the field of townhouse construction in Tan Binh district, Ho Chi Minh City, said that during the process of applying for construction permits, many unpredictable points may arise. Each pilot exempts construction permits
Previously, in 2018, Ho Chi Minh City piloted the exemption of construction permits for individual houses in Tan Quy ward, District 7. However, due to the requirement to have a 1/500 planning of the ward but in reality there is no such thing, the pilot cannot be implemented.
By 2021, the Ho Chi Minh City People's Committee issued Decision 56/2021 approving the Regulations on architectural management in the area, regulating the construction density, height, height of the building, rear areas, as well as architectural parts such as balconies, terraced roofs, ceilings, welcome roofs, basements, and floors for each street and every street. Based on this regulation, some housing subdivisions in urban areas have detailed plans 1/500.
Therefore, according to Mr. Le Hoang Chau, Chairman of the Ho Chi Minh City Real Estate Association, individual housing construction projects for individuals and households in urban areas with detailed 1/500 planning or approved urban designs should be exempted from construction permits. For individual houses in areas without detailed 1/500 planning in 1 ward, the Ministry of Construction can study to issue a temporary set of technical regulations. Mr. Le Hoang Chau said that one of the weaknesses and inadequacies at present is the adjustment of detailed zoning plans at a scale of 1/2,000. The appraisal and approval process of detailed plans 1/500 is very complicated. It is right to remove the construction permit, because the detailed 1/500 planning almost fully shows the rear area, high floor, and house design.
"For individual housing projects, households located in urban areas with a detailed 1/500 planning or approved urban design, should consider exempting construction permits. This will help reduce administrative procedures for small-scale, simple projects that have been controlled in terms of planning and design," Mr. Chau stated his opinion.
The Institute of Natural Resources and Environment of Ho Chi Minh City has just proposed that the leadership of Ho Chi Minh City allows people to register for construction, instead of granting construction permits today, under the direction of the Prime Minister. Accordingly, the Institute recommends that people should unify the construction of construction instead of construction permits from 1.7, based on the alley and architecture of housing construction prescribed in the architectural management regulations in Ho Chi Minh City.
At the same time, it is recommended to consider adjusting the height of construction works to at least one floor for works with an actual width of more than 5.5m and a minimum length of 12m in the regulations in the architectural management regulations of Ho Chi Minh City.
Experts say that the Construction Law has stipulated the removal of construction permits for houses in works and projects with approved 1/500 scale planning.
In addition, Ho Chi Minh City has regulations on architectural management regulations in Ho Chi Minh City (Decision 56/2021/QD-UBND) as a basis for granting construction permits.
Currently, Ho Chi Minh City has planned 1/2,000 plan for almost all areas. Based on the regulations on architectural management, Ho Chi Minh City will agree on the scale, construction density, backwards ... works.
