Expected cases where teachers are not allowed to apply the work responsibility allowance regime

The draft Decree regulating salary policies and allowances for teachers has many new points on salary and allowance policies.

The Ministry of Education and Training announced a draft Decree regulating salary policies and allowances for teachers to collect comments.

In particular, Clause 1, Article 7 of the draft Decree stipulates the level of benefits and beneficiaries of work responsibility allowances for teachers.

In addition to teachers who are entitled to work responsibility allowances according to the provisions of law, this Decree stipulates that some cases are entitled to work responsibility allowances at the following levels:

a) Level 0.1 compared to the basic salary applied to teachers assigned to provide student counseling;

b) A rate of 0.2 compared to the basic salary applied to teachers assigned to the task of deputy professional group or deputy department group according to the provisions of law; teachers directly teaching people with disabilities by integrated education in educational institutions that are not specialized schools or centers supporting the development of integrated education according to the number of hours of lecturing or teaching lessons for people with disabilities in practice;

c) Level 0.3 compared to the basic salary applied to:

- Teachers assigned to perform the tasks of key teachers from 05 days/month are entitled to responsibility allowances for that month;

- Teachers assigned to the task of professional group leader or department group leader or student management group leader according to the provisions of law;

- Teachers of ethnic minority languages in ethnic minority language training faculties at higher education institutions; teachers teaching foreign languages (except for teachers teaching Foreign languages);

- Teachers of ethnic minority languages in general education institutions, continuing education institutions and other educational institutions other than higher education institutions if they ensure the number of teaching hours according to the norm, including the average number of ethnic minority language teaching periods of 04 periods/week or more for teachers; the average of 02 periods/week of ethnic minority language teaching for principals and deputy principals;

- Teachers and managers of educational institutions working at specialized schools and centers to support the development of integrated education;

- Teachers directly teach people with disabilities through specialized education in educational institutions that are not specialized schools or centers to support the development of integrated education.

In addition, Clause 2, Article 7 of the draft Decree clearly states cases where the work responsibility allowance regime is not applied. Specifically:

- The work responsibility allowance regime for teachers, principals, vice principals and equivalent who have received responsibility allowances is not applied according to the provisions of Article 12 of Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government on policies for cadres, civil servants, public employees, workers and salary earners in the armed forces working in areas with particularly difficult socio-economic conditions.

The draft Decree is allowed for comments until November 9, 2025.
